UCC warns MTN over unfair practices

mtn

Last week, the media was awash with news reports about last Tuesday’s unfortunate incident where MTN Uganda switched off Africell subscribers from calling MTN numbers.

In one of the stories MTN claimed to have switched off Africell services based on a directive from the Uganda Communications Commission over non-compliance.

According to communication accessed by this website, MTN’s actions were not only unlawful but also wrong on over three grounds;

  1. a) MTN did not consult the regulator on the alleged “non-compliant” operators;
  2. b) MTN was in breach of their obligations to provide services under the interconnection agreement; and
  3. c) In contravention of rules of fair play, Africell was the only telecom operator that was illegally targeted and blocked by MTN on that day.

Africell Legal team has since clarified that their network is compliant with regulations set by the Uganda Communications Commission adding that Africell has always come out on top as the best rated network in terms of Quality of Service over the years UCC has carried out such tests.
Africell also maintains that MTN’s actions were illegal, made in bad faith and amounted to breach of the interconnection agreement, hence denying millions of Africell subscribers the right to make calls.

“It is therefore no surprise that MTN was ordered by the Uganda Communications Commission to immediately restore interconnection services to Africell Uganda on May 9, 2017” said the Africell Chief Operations Officer, Mohammad Ghaddar.

In the letter, which this www.eagle.co.ug has had access to, UCC cautioned MTN over their continued illegal acts over other players.

“The Commission wishes to express concern about the manner in which MTN unilaterally terminated communication services to Africell without first notifying the Commission…The purpose of this letter, therefore, is to order MTN Uganda to immediately restore interconnection services to Africell Uganda Limited.”

The Commission went further on to warn MTN not to terminate interconnection to an operator without informing the Commission prior to termination.

Such actions by MTN have time and again prompted operators to call upon the regulator to rein in on such unfair and illegal behavior that is intended to distort fair playing ground for all stakeholders in the industry including imposing penalties.

Over similar incidences, MTN Nigeria was fined US $5 billion for contravention of compliance rules, while on Tuesday May 16, 2017, MTN Rwanda was fined 7 billion Rwanda Francs over breach of license obligations.

Government has insisted that all unregistered sim cards be switched off today midnight despite a resolution of Parliament that suggested that registration be extended by a year ahead.

Following the directives from Uganda Communications Commission to all telecom companies, for disconnection of all unregistered simcards by May, May 2017, the government has stood on its ground directing that process will gradually with those with mobily money on cards, will have to redirect the money to their bank accounts.

While updating media at Uganda Media Centre, the Minister for Information, Communication and Technology, Frank Tumwebaze said the switch off will disable voice communication on the affected SIM cards, the exercise of verification continues just as registration of citizens is continuous.

The Minister’s statement follows Parliamentarians anxiety to government to extend sim card registration and verification for at least one year. The motion was moved on by the Leader of Opposition Winnie Kiiza to cater for those who have not yet registered for national identity cards

‘’Overriding objective of this exercise is to ensure national security the government had set the first deadline a month ago which was found prudent to give an extension of one month so as to enable many Ugandans that had registered for the national IDs but had not collected them’’. Tumwebaze said.

The practice for the criminals has been to acquire new sim cards that either are unregistered in any names or fraudulently registered with wrong and falsified identities for use in the execution of their criminal operations and thereafter, discard them so that they are not traced is almost coming to an end.

In this process of disconnection, the Minister assured that Mobile money services will still stand for unregistered and unverified simcards and National Identification and Registration Authority (NIRA) will temporarily allow new ID applicants for some period of time.

‘’The switch off really is to penalize you for non-compliance during the said period’’ the minister said

Through his lawyers Joel Olweny and Company Advocates, Mr Ayegasirwe filed a case before the civil division of the High Court on May 18, 2017.

He is also seeking court to place a permanent injunction against the Investigator restraining the publication, its editors and another employee from writing on him.

“By the defendants illegal and unconstitutional actions, the plaintiff’s standing status has been tarnished by the defendants, his reputation lowered in the estimation of the right thinking members of the public generally and the plaintiff is now shunned generally whereof he is entitled to compensation” reads the plaint.

He argues that the publication was made well aware that it was false and circulated by the defendant’s newspaper to millions readers by regionally and globally a thing that tarnished his image beyond repair.

Parliament blocks switching off sim cards

Speaker Rebecca Kadaga

With just hours left for Uganda Communications Commission to deactivate unregistered sim cards, Parliament has passed a motion ordering for the extension of the registration by not more than one year.

The motion was moved by the Leader of Opposition in Parliament, Winnie Kiiza.

“Most of the people have mobile money contributions in their Mobile Money. What would be the fate of this deadline? We must remember that the registration for National ID was first intended for persons of voting age?” she asked.

The motion was supported by her colleagues including Egunyu Nantume Janepher, the Woman MP for Buvuma.

“Considering that registration of people below 18 and above 5yrs is ongoing, i support extension but not for a year.Extension for a year is too long. This is why Uganda is weak in implementing laws.”

Commenting on the motion, Kadaga said, “The condition that would apply is that NIRA avails Ugandans with the information they captured. When these people were registering us, they found us in our villages. The machines are still available and can be used.

“Let us pass this motion, and let government come up with the date for ending it,” Rosemary Nankabirwa, the Govt Chief Whip, suggested.

Kizza suggested that the “Governmentt is not aware that people don’t have their ID cards. I would want NIRA to feature in the resolution.” She subsequently passed the resolution extending the registration exercise by not more than a year.

Lone South Sudan children fleeing to Uganda-report

Over 355 million children survive on less than $1.90 per day

More than 100 lone children cross into Uganda each day as they flee conflict in South Sudan, walking for days on end with no food or family to sustain them, an aid agency said on Thursday.

World Vision said at least 9,000 children had made the journey since last July and it expects another thousand to join them by mid-year.

“The majority of these children saw their parents being killed, while others lost touch with their families once fighting broke out. Some of them walk for more than a week to get to Uganda, with nothing to eat,” said Gilbert Kamanga, country director of World Vision in Uganda.

“This is one of the worst forms of violence against children. It must stop. Peace needs to prevail in South Sudan,” he said in a statement.

Uganda hosts some 898,000 refugees, with more than 2,000 people arriving daily, mostly women and children, according to the United Nations refugee agency UNHCR.

Children make up 62 percent of the 1.8 million people displaced by fighting in South Sudan, and more than 75,000 unaccompanied children have fled to Uganda, Kenya and Ethiopia, the UNHCR said.

Two years after independence, South Sudan plunged into conflict in 2013 after rivalry between President Salva Kiir and his then-vice president, Riek Machar, exploded into violence.

A 2015 peace deal was signed but the terms were never fully respected. Lingering suspicions between Machar and Kiir triggered a fresh bout of fighting in July 2016 and violence has since spread to large areas of the country.

United Nations agencies on Monday increased their 2017 appeal for South Sudan’s refugees, saying they needed at least US $1.4 billion to help support those fleeing fighting.
