Riham ‘Sky View’ advert sparks sky-high outrage

COPIED? The 'Sky View' advert that caused social media outrage

Whilst most rival companies compete to outdo each other’s products in a bid to monopolize their respective markets, Harris International, the manufacturers of Riham Cola, allegedly rides on the creativity of rival companies and their products’ success.

According to social media rants by sections of Ugandans, Riham, the Kawempe-based soft drinks manufacturer, uses advert designers or agencies that are disrespectful of its competitors products’ copyrights and trademarks.

At issue is the ‘Sky View’ advert, announcing Harris International’s latest product, which social media activists said is almost a replica of the advert announcing ‘Mountain Dew’, a product of the rival Nakawa-based soft drinks manufacturer Crown Beverages Limited, producers of Pepsi-Cola and Mirinda among other brands.

According to the critics, the advert that announced the release of ‘Sky View’ didn’t only incorporate certain themes or ideas behind the original Mountain-Dew advert, but instead ‘stole’ the whole advert pixels and all with only a few tweaks done to a few details like the names and tagline.

‘This is what happens when a company or brand leaves the skilled and qualified individuals out and hires someone because he or she is related to the HR or marketers. Can I say Riham Copywriter and Designer ‘copied-and-pasted’ the Mountain Dew art work. But where is Uganda heading?” someone going by the moniker MC Young Wizy, a ‘digital content writer and social media guru’, wrote on his Facebook page.

John Edwin Danze, a Digital Marketer with NBS Television expressed concern over the advert when he posted the picture and captions: “Ladies and Gentlemen, I present to you Riham Cola Sky View aka poor man’s Mountain Dew. They took ‘Do the Dew’ very literally. How is this even legal!?” he asked.

A couple of other people weighed in, with some calling for the company to be sued while others called for close monitoring and regulatory specifics by the Uganda Communications Commission, to control such emerging challenges.

According to the Riham adverts’ critics, the company’s media and advertising department blatantly ‘copy-pastes’ work and signature marks that are already in circulation to distinguish a particular product.

They charge that this is not the first time the Kawempe-based factory has tried to duplicate, reproduce or plagiarise the works and innovations of rival companies for its own marketing strategies.

According to them, in 2013 Coca Cola sued Harris International over trademark infringement, although the case was settled out of court.

“This has not hindered anything as more products with similar tell-tale signs of duplicity continue to hit the market; a clear indicator of Uganda’s ever prevalent atmosphere of mediocrity,” said another critic, speaking on condition of anonymity.

However, contacted Harris International denied it had an idea such similarities between the two products existed.

“No, not at all. These are two separate products and Sky View is our very own product that has nothing to do with the other…,” an official said.

Another product that brought them under scrutiny in 2013 was their famous Riham Cola that had distinct similarities to Coca Cola’s Coke.

Issa Hayatou’s 29 year reign as CAF president ends in embarrassing defeat

Issa Hayatou

Issa Hayatou’s 29-year reign as head of the Confederation of African Football is over after Madagascar’s Ahmad Ahmad beat him in a presidential election on Thursday.

Ahmad, 57-year-old, who goes by just a single name, won the CAF presidency by 34 votes to 20 in the poll, bringing to a surprise end the 29-year tenure of the 70-year-old Hayatou, who is from Cameroon.

The result was greeted by cheers at the CAF congress as Ahmad was carried on the shoulders of jubilant supporters to the podium after the result was announced.

Ahmad, previously minister of sport and minister of fisheries in his home country, had been given little chance just a month ago when he announced his candidacy.

But he offered voters a fresh face to a younger generation of soccer association presidents that have emerged.

Hayatou’s long career in soccer is now at an end, although he is still an International Olympic Committee member.

“It is not that bad,” Hayatou, who was first elected in 1988, told reporters as he departed the hall.

“I’m not a candidate who will serve his personal interests.

“African football cannot be managed by bandits,” Ahmad Ahmad said in a statement before the voting at a congress in Ethiopia took place.

He said: “I will reorganise CAF’s financial sector to make it accessible to all sectors and areas.

“Five million dollars, or 50 per cent of earnings from FIFA, will go to African federations.”

Trump threatens Snoop Dogg with jail

Snoop Dogg’s new “Lavender” music video features a world of clowns, and one is clearly a President Trump parody.

In one climactic moment, Snoop Dogg aims a toy gun at that clown — “Ronald Klump” — and pulls the trigger. Glitter and a banner reading “Bang!” pop out.

Trump weighed in on that scene Wednesday morning, tweeting, “Can you imagine what the outcry would be if @SnoopDogg, failing career and all, had aimed and fired the gun at President Obama? Jail time!”

With the video’s release this week, Snoop Dogg told Billboard that he wasn’t looking for a response from Trump or anyone else with that particular scene.

“I don’t ever expect or look for a reaction. I just put it out because I feel like it’s something that’s missing. Anytime I drop something, I’m trying to fill in a void,” he told the outlet. “I feel like it’s a lot of people making cool records, having fun, partying, but nobody’s dealing with the real issue with this … clown as president.”

Trump and Snoop Dogg actually have a bit of a history together. The rapper appeared on season six of “The Apprentice,” in which the winning contestants got to create a song with Snoop Dogg.

And Snoop was on hand for the Comedy Central roast of Trump, which aired back in 2011, after Trump publicly floated the idea of running for president.

“Now, Donald say he wants to run for president and move on into the White House,” Snoop Dogg said, as Trump grinned. “Why not? It wouldn’t be the first time he pushed a black family out of their home.”

Nabbi Omukazi – ‘pastor’ Yiga fight takes nasty turn

Kayima

Singer Maggie Kayima popularly known as Nabbi Omukazi has warned her former boss and fiancé, ‘pastor’ Yiga of the ‘Abizayo’ fame to stop making her a topic on his TV station.

In a scathing statement, a seemingly furious Kayima warned Yiga that if he doesn’t leave her alone, “I’ll be forced to fight back and I promise you, you won’t live to tell the tale cause you know how far I can go,” reads part of her statement.

She is responding to recent remarks apparently made by Yiga on his ABS TV. While in ABS TV, Yiga claimed the reason why Kayima was recently involved in an accident was because she was reluctant to apologise to him.

However, Kayima dismissed the claims as entirely lies.

“Stop telling lies to your followers by simply clinging on the light misfortunes happening to me….. A person called a prophet is not your fellow human and you know it very well – I am not easy. “She wrote.

Adding “If I managed to survive Aids after being with someone (Yiga) for eight years, you tried to put me down with your “kalondoozi” videos but it still failed. I recently survived a nasty accident, which was much worse. If I survived all of that, you ought to leave me alone because I am not your level. Never joke with an anointed person.”

She vowed never to apologise to him for leaving his Revival Band, saying “the day I come back to you is the day you’ll prove to us that your powerful and to be honest, I don’t see that ever happening, never. You will remain what you are and what you have always been weak.”

Parliament to investigate tax evasion in steel rolling

MP Ssekikubo.

Parliament has resolved to investigate tax evasion in the steel rolling sector, estimated to be worth in billions of shillings.

A motion passed on Wednesday, March 15, 2017, allowed Parliament to investigate the tax evaders, was moved by Bukooli North Member of Parliament, Gaster Mugoya and seconded by Rwemiyaga legislator Theodore Ssekikubo and Bundibugyo district Woman Member of Parliament Ms Norah Bigirwa Nyendwoha.

“Whereas the steel sector has potential to greatly contribute to the development of the country, this is not the case because of chronic and systematic tax evasion prevailing in the sector,” the resolution reads.

Currently, Uganda has about 12 steel mills with the production capacity of more than 500,000 tonnes of steel products annually and more than 23 other manufacturers and importers.

Government has been protecting domestic iron and steel mills against unfair competition from cheaper imported steel and iron products to Uganda from the regional markets but these companies have been evading taxes.

Opondo slams HRM report on Kasese killings

Mr. Ofwono Opondo.

The Executive Director of Uganda Media Centre (UMC), Ofwono Opondo has lambasted a report released today by Human Rights Watch.

In a statement issued this evening, Opondo says the report promotes violence in the region referring to machetes as agricultural tools as opposed to Uganda penal code act that defines them as lethal weapons.

“Today’s HRW report ignores the death and causalities the militias inflicted on members of security forces and civilians over the years. It further promotes violence in the region referring to machetes as “agricultural tools” as opposed to Uganda penal code act that defines them as lethal weapons.” Mr. Opondo said.

Below is the statement in full.

March 15, 2017: We have today, received a report of Human Rights Watch on the November 2016 Kasese incidences, titled “Uganda: Ensure Independent Investigation into Kasese killings”. Our examination of the report however reveals several inconsistencies and flaws that do not represent the true facts of the subject matter. The report lacks depth, especially on the genesis of the near break down of law and order, which almost plunged the Rwenzori Sub Region into anarchy.

It deliberately omits the incidents that led to the security forces responding, not only to defend themselves but also to maintain law and order. The following need to be noted for those who may have missed out on the background of this situation:

  • July 7, 2014; militia groups allied to Obusinga Bwa Rwenzururu in the Rwenzori region carried out coordinated attacks against security forces and civilians. Altogether, they carried out 13 attacks as follows:

At 3.00pm, they attacked policemen at a weigh bridge at Hima, killed a policeman, injured another and took away two (02) sub machine guns.

At Bigando, a UPDF soldier who was on pass leave was killed in cold blood and his family burnt in his house.

In Bigando, the militia also killed six (06) Basongora civilians.

At Karugutu police post, these lawless people injured one policeman and took away one (01) sub machine gun.

At Kikyo police post, they took one sub machine gun.

At Kirumiya police post, they took one sub machine gun.

At Ntandi, they took 2 sub machine guns from the Uganda Wildlife Authority (UWA) personnel.

At Kibuku, they ambushed UPDF soldiers who were taking reinforcements to Bundibugyo, killed one of them and took one SMG, but the attackers were neutralized.

In Bundibugyo, they attacked the police station, killed the officer in charge of station and one policeman. They took his weapon.

They attacked Stanbic Bank but the attackers were neutralised.

These same militias attacked the camp of 39 Battalion at Kanyamirima injuring one UPDF captain and killed one soldier. They were however repulsed.

The attack on the palace of Bamba king saw one gun being taken and one policeman injured.

On March 3, 2016, two soldiers who were on pass leave were kidnapped by Obusinga Bwa Rwenzururu militia near the Kasese palace as they passed by. The two were killed.

On March 10, 2016, six soldiers on patrol were attacked, hacked with machetes by Obusinga bwa Rwenzururu militia and left seriously injured by the road side.

On the evening of March 15, 2016, the GISO of Kyabarungira sub county and his brother were attacked and stabbed in Kasese town, by suspected OBR Youths leaving them seriously injured.

On Mar 23, 2016, a gang of criminals associated to OBR cultural guards, armed with machetes, attacked Kidodo Police post in Kasese Municipality, leaving 01 police man killed and 01 gun taken.

On the morning of March 23, 2016, clashes in Ntotoro sub county of Bundibugyo left 20 people killed, sparking a fresh wave of IDPs, approximately 5000 who sought refuge in Bubukwanga Camp.

On November 5, 2016, one soldier on pass leave was killed in Karangura sub-county, Kabarole district by militias claiming loyalty to the Bakonjo King.

On November 25, 2016, security forces recovered two submachine guns and disbanded a militia camp at Karangura subcounty in Kabarole district.

On November 26, 2016, using their Prime Minister’s Office as a base , the militias carried out simultaneous attacks on police posts like at Hima, Bwera, Maliba, Mubuku, Bwesumbu, Buhuhira and Bugoye, killing 16 police officers and made off with weapons.

On November 26, 2016, the security forces disbanded the attackers’ camp at Ihandiro and recovered submachine gun and magazines, fuel bombs, Obusinga Bwa Rwenzururu uniforms, machetes, among others.

On November 27, 2016, security forces raided the Obusinga bwa Rwenzururu palace in Kasese, recovering a number of petrol bombs, machetes, and Obusinga Bwa Rwenzururu uniforms. Guns recovered from the palace were the same that had been earlier stolen from the police. Directives were issued by government to the militias to disband in accordance with the laws, and in the interest of national security, but they regrettably decided to ignore all the calls, thus necessitating government intervention. Today’s HRW report ignores the death and causalities the militias inflicted on members of security forces and civilians over the years. It further promotes violence in the region referring to machetes as “agricultural tools” as opposed to Uganda penal code act that defines them as lethal weapons. History reveals that machetes have been used in the great lakes region to cause genocide. As opposed to the HRW report that sixteen children were killed during the operation, there is no evidence to back this falsehood. UPDF has a well-documented record of protecting children, women and non-combatants wherever it has operated. Government of Uganda challenges the authors of the report to mention the families of missing persons and the alleged dead children. They should also provide evidence of deliberate and systematic targeting of children and women. 5 Our record establishes that a total of 103 deaths were registered. Out of these, 91 were male and 12 female, 16 of whom were police officers. A total of 51 bodies were unclaimed and were subsequently buried in a public cemetery in Kasese after toxicological and DNA samples were taken from each body and have been stored for any future reference. Therefore, anybody who claims a missing person can contact the police. The report recommends independent investigations on a matter before the courts of law. This is untenable for now because it is at odds with the subjudice rule. However, Uganda does not lack independent investigative capability if there is need. And therefore, the call to suspend some commanders from their duties or restrain them from conducting government duties is uncalled for and unacceptable. The main focus of government has been pursuing criminal investigation, bringing suspects to prosecution and restore order which is being achieved.

Ofwono Opondo

Executive Director
