LDU officer sentenced for assaulting Mityana District Chairperson Joseph Luzige

The Uganda Peoples’ Defence Forces’ (UPDF) first Division Court Martial chaired by Col Sam Mugyenyi has acquitted two Local Defence Unit (LDU) Personnel of the charge of assault causing bodily harm to Mityana District Chairperson, Mr. Joseph Luzige.

The court also reduced the same charge placed against a third militant to common assault after the complainant was found to have falsely accused the militants and initiated the scuffle.

The trio; LDU Okello Isaac, LDU Odeke Solomon and Lance Corporal Angulia Simon Peter had been arrested and charged for assault causing bodily harm following an incident of 7th July 2020 where they were filmed in a scuffle with the LC V Chairman as they enforced the COVID-19 directives and allegedly injured his eye.

The two LDUs were acquitted when the court proved their innocence after cross examination of four witnesses, including the complainant. There was no proof that the District Chairman’s eye was injured or that he had obtained grievous bodily harm as he alleged. A witness, Dr. Lubogo, denied having treated the District Chairperson after the scuffle as had been recorded in the charge sheet and statements. Dr. Lubogo is a Senior Medical Officer in Mityana.

Eye witnesses also proved that it was the District Chairman who sparked off the brawl by being the first to violently grab Lance Corporal Angulia Simon Peter by the collar of his military attire while on duty.

Nevertheless, considering the subsequent actions of Lance Corporal Angulia against the district leader, having failed to observe restraint as required by the Standing Operating Procedures, court did not set the accused free but rather reduced his charge from assault causing bodily harm to common assault. He was convicted of common assault and sentenced to four months’ detention in a government prison.

This case has been concluded after three court sittings; at Kakiri for mention and twice at Mityana for hearing. This followed a visit of Mityana by a team comprising the Deputy Commander Land Forces Maj Gen Sam Kavuma, first Division Commander Maj Gen Samuel Kawagga, and the Chief Political Commissar Maj Gen Henry Matsiko, to make inquiries on the alleged assault of the District Chairperson. The UPDF has a zero tolerance policy on indiscipline and remains respectful to the civilian authority.

Renewed Uganda pressure group condemns Gen. Tumukunde arrest

The Renewed Uganda pressure group has condemned the arrest of it’s presidential candidate Lt Gen Henry Tumukunde.

“Renewed Uganda wishes to condemn in the strongest terms possible the actions of Police in arresting it’s presidential candidate Lt Gen Henry Tumukunde who was conducting lawful consultations in Buikwe,”reads the statement.

It adds that:” We also condemn the actions of the Police in intimidating our candidate and the Taskforce by arresting the volunteers/mobilisers of the Taskforce.”

The Criminal Investigations and Intelligence Department (CIID) this week summoned Lt Gen Tumukunde to explain why he met army veterans to discuss his presidential bid.

In it’s statement, Renewed Uganda also challenged the Police to explain why it continues to clamp down on opposition activities while allowing ruling party politicians to freely operate.

Renewed Uganda also urged Ugandans to be vigilant in protecting their votes, saying that actions such as the arrests in Nansana and the police summons are intimidation tactics.

Meanwhile, Gen. Tumukunde is this morning expected City Hall court for hearing of his treason case.

Attorney General William Byaruhanga on the spot for acquiring firearm for Andrew Kasirye

Attorney General William Byaruhanga is on the spot for acquiring a firearm for his partner Andrew Kasirye at a time when the joint security committee had put to halt the issuance of arms to private individuals.

According to police sources, Mr. Byaruhanga used his position as Attorney General to intimidate junior officers to have a gun licensed to  Andrew Kasirye. In 2018, security issued a halt in licensing of firearms to private individuals after allegations that the rampant murders in the country were linked to the private firearms in the hands of individuals.

In April 2018, letter to Internal Affairs Minister Jeje Odongo titled recommendation for Andrew Kasirye to be granted a firearm license.

“I have been requested by Mr. Kasirye for a recommendation for purposes of obtaining a firearm license under the Firearms Act 1970. He has informed me that the Luwero Industries Limited has offered for sale to him a new pistol NP349MM Serial No BO19885. A copy of the letter dated April 13, 2018is appended hereto for case reference”. Mr. Byaruhanga wrote.

He further added “Mr Kasirye has been practicing as an Advocate since April 16, 1986 and has since 1991 been my partner in the firm of Kasirye, Byaruhanga and Company Advocates. he was recently awarded the rank of Senior Counsel by the Law Council of Uganda. I am therefore, well qualified to attest that he is a citizen of good standing and indeed a fit and proper person to be issued  with a firearm license”.

However, this website has reliably learnt whereas Byaruhanga was well qualified to recommend his colleague for the firearm, the time was suspicious given the ban on the issuance of guns. It is also alleged that what prompted the questioning of this whole process was the saga recently that involved Mr. Byaruhanga and and another top businessman over a land dispute along Entebbe Road. It is alleged the saga that degenerated into a personal fight saw guns drawn by one of the two.

DTB’s Shs120b fraud accusations could be the reason for the bank’s escalating customer attrition

Businessman Hamis Kiggundu threw Diamond Trust Bank (DTB) under the bus following the bank’s illicit and irregular transactions amounting to Shs120 billion on his US dollar and Shilling accounts.

Information between the banking corridors indicates that customers are not taking chances with the uncertain future of DTB and have started withdrawing their money as they quit amidst fear that the bank’s huge fraud scandal it is facing.

The bank has for long been accused by Ham Enterprises of irregularly, fraudulently and illegally deducting monies from the Company’s shillings and US dollar accounts totaling approximately Shs120 billion during a spread period of about ten years they have worked together as lender and borrower.

Ham Enterprises in court papers prove that DTB fraudulently withdrew 34,295,941,533 billion from a shillings account and 23,467,670.61 Million from a United States Dollar Account as per the account statements for a 10-year banking relationship that they had operated those accounts.

Now, the case being processed in court has unsettled customers who according to inside information from the bank have started withdrawing their money. They fear that the ongoing scandal reveals the true colors of the financial institution.

The company has strongly protested the bank’s action in court. Recently, the Commercial Division of the High Court in Kampala set aside regulation 13 of the Mortgage Act 2012 requiring Ham Enterprises (U) Ltd to make a security deposit of 30 per cent of contested money.

“The Mortgage Act was enacted in 2010. However, it was not until 2012 that Regulation 13 under the Mortgage Regulation 2012 that requires payment of a 30 per cent deposit was smuggled into the laws of Uganda as a photocopy to the income tax law which required a taxpayer to pay URA a deposit of 30 per cent on an assessment before they could challenge such assessment at courts of law,” Ham Enterprises said in its appeal.

“Banks have always used this law (Regulation 13) to push their clients to the wall denying them the right to a fair hearing.”

The Commercial Division of the High Court further issued an order restraining Diamond Trust Bank Uganda and Its mother company in Kenya from interfering with commercial properties belonging to Ham Enterprises (U) Ltd and the company proprietor Hamis Kiggundu.

This victory against DTB has placed it in a tight spot and customers are not taking any chances, risking their precious monies with a bank industry player, which they believe is easily collapsing.

In the past with banks like Greenland Bank, customers have lost huge sums whenever a bank collapsed. A repeat of such is what they are not willing to suffer and that matter, they are quitting the bank.

Recently, following numerous media reports indicating that bank is nearing bankruptcy, DTB assured its customers that they are still financially sound and described reports in the media as untrue and malicious. The bank said the Ham Enterprises case could not render it unviable and put it on the verge of collapse and possible takeover by Bank of Uganda.

However, this assurance from the bank has not managed to buy customer confidence. An employee in the bank who asked not to be named to protect her identity and job said most customers quitting the bank are the SMEs who can’t afford to lose their savings or work capital.

“Imagine a kikuubo man, in this COVID time, to lose hundreds of millions. So, there is that panic. We doing all to reassure the customers but looks like the damage has been done. It is not just the Ham issue; disgruntled customers have been making noise and its becoming loud. Of course, we have almost collapsed but we can’t afford to lose customers and these huge deposits at the rate it is happening,” the DTB employee said.

Bank of Uganda has not said a word as it still treats this matter as a rumor but as the sector’s regulator it has to come in at some point to reassure the public and protect the bank and the entire financial sector.

Some bank customers have however not waited for BOU’s intervention as they have already started mass withdrawals in fear for their money.

It should however, be remembered that while speaking to the Parliament committee of COSASE in April last year, the deputy governor Dr. Louis Kasekende said that “Nearly all the banks we closed or sold in Uganda failed because of outright fraud by shareholders, excessive lending of funds to insiders – managers and shareholders, collusion to cover up irregularities between board of directors and the management, and misreporting of the true state of the bank’s financial position, among many factors”. Dr. Kasekende further added that, “The Bank of Uganda only intervenes in a financial institution when it has reasonable belief and evidence that continued operations of that institution pose serious risk of loss to depositors’ funds.”

According to Ham Enterprises letter that terminated all agreements with Diamond Trust Uganda and Kenya: the same reasons given to parliament by Bank of Uganda in support for closure of the now defunct banks are very identical reasons that Ham Enterprises Cited when leaving the Bank.

If DTB loses this Shs120Bn fraud case as it has partially been with; the 30 per cent deposit requirement and A restraining order against attaching any properties, then the Bank is in much trouble.

Court will begin hearing the main application of Ham’s suit starting August 27 before the commercial court.

Brig Gen Kwikiriza urges soldiers to observe human rights

Uganda Peoples’ Defence Forces’ (UPDF) Mountain Division Commander, Brig Gen Moses Kwikiriza, has called on members of the UPDF to consider the observance of human rights as a critical responsibility during military operations.

“Our key task as the UPDF is the provision of a right to security. We must however ensure strict observance of all other rights as we execute our tasks. In this way, we will be positively adding the right to security to the overall human rights in the country,” said Brig Gen Kwikiriza.

He added that the UPDF works with, for and in the interest of human beings (the people) and so individual inhuman actions that infringe on peoples’ human rights undermine the reasons for the UPDF’s existence.

Brig Gen Kwikiriza observed that there are many ways people unknowingly or intentionally infringe on other peoples’ rights. Taking example of the current challenge at hand, he noted that individual’s failure to observe the COVID-19 guidelines in itself is an act that infringes on other peoples’ right to health as well as their own personal health rights.

“The State has responsibility for your life. You can be charged for trying to unlawfully take it away or endanger it or to endanger that of others,” he cautioned.

He called for especially wearing of masks in public places, social distancing, staying home where necessary and regular washing of hands or sanitizing. “The army needs you strong and alive. And, we should at all times be seen to be protecting the public in totality, including against COVID-19 by mobilizing them not to contract the disease and us living the example by following all the guidelines,” he added.

Brig Gen Kwikiriza made the remarks while officiating at the hand/take over ceremony between the outgoing 222 Mountain Brigade Commander, Col Keith Katungi, and the incoming Brigade Commander, Lt Col Christopher Tumwine, at the Brigade Headquarters at Hima in Kasese district. Col Keith Katungi recently took over as the Commandant Military Police based in Makindye.

Col Keith Katungi tipped the incoming Brigade Commander that his success will depend on the level of team work in the formation and his cooperation with the civilian community. The incoming Commander pledged to offer his best in exercise of his duties.

Present at the function were the Brigade and Battalion Commanders under Mountain Division as well as the Brigade Staff Officers.

Besigye steps down, will not contest in 2021 elections

The main opposition politician in Uganda and four time presidential candidate, Dr. Kizza Besigye has revealed that he will not contest for any elective position in the coming 2021 general elections.

The former Forum for Democratic Change (FDC) party  president used the opportunity to welcome several aspirants who include; Patrick Oboi Amuriat and his contemporary Wasswa Birigwa who are vying for presidential flag bearer.

“Patrick Amuriat is a seasoned and tested politician who has been here for over a decade. Birigwa has been own chairman. They are all capable of carrying the flag and leading this country,” he said at party headquarters in Najjanankumbi.

However like all political gatherings within this election period, the function was not without interruptions as they were temporarily disrupted by the youths who demanded and pleaded for the former party head, Dr. Kizza Kifefe Besigye to pick up nomination forms before he could address them.

Despite several calls from those in attendance for his re-election, the former party leader made it clear that he would not be running for the president’s office in the upcoming elections. The bush was colonel has always been seeking to unseat his former boss and bush war comrade Gen. Yoweri Museveni.

He further congratulated the aspirants and urged the party to ‘embrace different channels in their fight for leadership.

After being the party’s foreman since 2001, it was clear that the doctor’s departure from the helm was met with a number of mixed reactions as some couldn’t believe it while others felt it was necessary for the growth of the party as a democratic and independent entity of Uganda’s politics.

According to political analysts stepping down was a result of circumstance rather than personal choice given the velocity with which the newly created ‘National Unity Platform’ has taken centre stage in the opposition corner; it was only a matter of time before Uganda’s opposition rallied behind the new bloods and their fresh wave of zeal and energy.

EAC Young lecturers benefit from China-EASTRIP TVET Scholarship Programme

Young East African lecturers from Ethiopia, Kenya and Tanzania Regional Flagship TVET Institutes (RFTIs) supported by the World Bank East Africa Skills for Transformation and Regional Integration Project (EASTRIP) have been awarded scholarships to upgrade their qualification in Science and Technology to support advancement of Technical, Vocational Education and Training (TVET) in East Africa.

The scholarships were awarded by the Chinese government, as part of the tripartite partnership between the Inter-University Council for East Africa (IUCEA), the People’s Republic of China through the Ministry of Education, and the World Bank to promote excellence in TVET and facilitate regional integration in East Africa.

The programme which was signed in Beijing in November 2019, commenced in the 2020/2021 academic year, will offer over 100 scholarships to qualified young lecturers who are currently teaching in the RFTIs for the next five years to pursue master and PhD level study at top Universities and Technical Colleges in China.

The programme is intended to compliment the World Bank EASTRIP support but with laser focus on improving the much needed academic, technical, and pedagogical capacity of the faculty in the growing sectors of the economy including but not limited to Manufacturing, ICT, Energy, ICT, Agriculture, and Transport and to promote regional integration.

Candidates went through a rigorous multilevel selection process involving the college management, IUCEA, the China Scholarship Council, and Chinese universities.  Among this year’s awardees, X are from Ethiopia, Y are from Kenya, and Z are from Tanzania, all going to top STEM universities in China including Tsinghua University and Zhejiang University.

The World Bank Task Team Leader, Dr. Xiaoyan Liang, said there is a critical shortage of qualified teachers and trainers in the TVET institutions in Africa and the scholarship is designed to fill some of the important gap. “It will produce a core cluster of highly qualified staff to design and deliver quality demand-driven training programmes and to transform the RFTIs into true flagship institutes.  The scholarship will also help improve the image of TVET and enhance female enrolment in technology and engineering fields which is still low,” Dr. Liang said.

EASTRIP is currently supporting 16 Regional Flagship TVET institutes (RFTIs) in the region to improve access and quality of TVET programmes for economic transformation and regional integration.

The Scholarship is open to both male and female students from Ethiopia, Kenya and Tanzania under the age of 35 years for Masters Programs and under the age of 40 years for doctoral programs. Out of the 20 selected candidates for the 2020/2021 academic year, 6 are females.

The 20 scholarships are available annually for five years, to support college students and teachers from Ethiopia, Kenya and Tanzania to pursue relevant technical and engineering master’s or Ph.D. degrees in top Chinese universities and technical colleges.

KIU to hold virtual graduation ceremony

Kampala International University (KIU) is set to hold a virtual graduation ceremony for all students who completed their courses. The 22nd graduation ceremony will be held on August 22nd starting at 2:30 PM.

Initially, the graduation was slated for June however it was postponed due to the COVID-19 pandemic as earlier announced by the University Vice-Chancellor, Dr Mouhammad Mpezamihigo, and consequently, the KIU University council and the University senate decided that the graduation take place on Saturday, August 22.

“For purposes of preventing the spread of the pandemic, and in compliance with the Standard Operating Procedures by the Ministry of Health of the government of Uganda, the KIU University Council and the University Senate decided that the graduation be held online (virtual) on Saturday, 22nd August, starting at 2:30 PM East African Standard Time,” reads the announcement from the KIU University Senate and published by the Director, Academic Affairs.

According to the announcement, an online graduation clearance form is available on the university website. All potential graduands were required to fulfill all the requirements before they can be allowed to graduate and receive their academic documents.

The entire graduation ceremony will be conducted via Zoom, the University Facebook page and website, and on YouTube, upon commencement of the convocation by the Chancellor.

The event will also be streamed on selected TV and radio stations and therefore, no graduands and family members are expected at Campus. The Chancellor will declare commencement of the 22nd KIU Graduation Ceremony online, at the stipulated date and time.

All speeches (Chancellor, Vice-Chancellor, Chairperson University Council, Chairman Board of Trustees, Guest of Honour and the Chief Guest) will be delivered online

Graduands’ names will be presented online by the respective Deans and Principals. A soft copy of the graduation booklet will be made available on the University Website.

Graduands whose awards require oath-taking will be provided with the oath that is to be taken online. Each oath-taking graduand will be required to submit a signed copy of the oath before the date of graduation. Graduands in this category are urgently required to contact their respective Deans for further details on the modalities that must be fulfilled before 15th August 2020.

All academic awards (certificate, diploma, and degree, Postgraduate Diplomas, Masters and PhDs) will be conferred by the Chancellor online

The dissolution of the convocation and graduation ceremony by the Chancellor will be conducted online.

The collection of academic documents will be scheduled by the Directorate of Academic Affairs in such a manner that it complies with the standard operating procedures of the University and the Ministry of Health to prevent the spread of the Covid-19 pandemic.

MTN appoints Ralph Mupita as new CEO

MTN Group today announced that the current group CFO of MTN Group, Ralph Mupita, has been appointed as the new group president and CEO with effect from 1 September 2020.

Ralph has served as the MTN Group CFO since April 2017 and has played a critical role in the development and execution of the group’s strategy, capital allocation processes, financial performance as well as in the resolution of a number of complex regulatory matters.

MTN Group chairman Mr Mcebisi Jonas said: “After a rigorous and extensive search process, we are pleased to have appointed someone of Ralph’s calibre, experience and ability to fill the group president and CEO position. Ralph’s experience as the group CFO, strong knowledge of our businesses and markets, as well as successful background in financial services, M&A and emerging markets, place him in an excellent position to lead the growth and sustainability of the business going forward.”

Ralph is a graduate of the University of Cape Town with a degree in Engineering and an MBA. Prior to joining MTN Group, Ralph was the CEO of Old Mutual Emerging Markets for five years, a business that provided financial services to individuals and corporates across 19 countries in Africa, Latin America and Asia, managing over R1 trillion of customer assets under management at the time.

Commenting on his appointment, Ralph said: “Leading a business with MTN Group’s history, scale and socio-economic impact is a privilege and honour, and I look forward to working with the group board and executive committee in driving growth and unlocking value for shareholders and broader stakeholders.”

The current group president and CEO, Rob Shuter, will step down from his executive responsibilities on 31 August 2020 and will thereafter support Ralph as required until the end of his fixed-term contract early next year.

An update regarding the GCFO position will be made on or before 1 September 2020.

Patrick Amuriat picks FDC presidential nomination forms

The President of Forum for Democratic Change (FDC) Patrick Amuriat Oboi has picked nomination forms to compete for Party presidential flag bear in the 2021 general elections.

Accompanied by his supporters, Mr. Amuriat picked was received by Mr. Toteremuka Bamwenda, the FDC Party electoral commission Chairperson. He picked nomination forms amidst cheers, chanting and jubilations. He is expected to pay Shs 5million.

He is expected to traverse throughout the country to get 20 signatures from party delegates among other requirements before returning the nomination forms.

In his remarks, Amuriat pledged to carry the party flag and win the 2021 presidential elections. “You have always criticized me but I want to press you in the right place as I seek to lead this country,” he said.

Last week party spokesperson Ibrahim Semujju Nganda said that should Besigye accept to be the party’s presidential flag bearer then he will be endorsed as a sole candidate, but in the event that he doesn’t take up the mantle, then other candidates who offer themselves will go through internal elections as enshrined in the party’s constitution.

Amuriat is the FDC Party President having won elections on 24th November 2017, in the FDC 7th National Delegates Conference that was held at Mandela National Stadium, becoming the Third (3) President after Maj Gen. Gregory Mugisha Muntu (November 2012-November 2017) and Dr. Kizza Besigye (2005 – November 2012).
