Workers’ MP calls for formation of Parliament select committee to probe Makerere

A section of Makerere University staff are rooting for the formation of a Parliament select committee to probe the mighty academic institution.

In a petition to Speaker Rebecca Kadaga, suspended Makerere University Academic Staff Association (MUASA) Chairperson, Deus Kamunyu, accused Vice Chancellor Prof Barnabas Nawangwe of witch-hunting him, saying Parliament should come to their rescue.

In a meeting with the Kadaga, Workers’ MP Sam Lyomoki called for the formation of a Select Committee to dig deeper into wrangles between the teaching staff and the administration.

“There was a petition by workers, which was presented to you Speaker, the Vice Chancellor is persecuting them, his actions are illegal and unconstitutional,” said Lyomoki, “We need a select committee to look into this,” he added.

Kamunyu said his suspension is related to his involvement in industrial relations activities, asserting that parliament’s intervention is required and that students should not miss school because of the impasse.

“We hope that the University Management will not use the students as pawns, we had thought we would first iron out these issues before students are called back. Unfortunately, that has not happened,” he said.

Kadaga said to make a decision on the standoff, the petitioners should first furnish her with the ‘Rwendeire report’, which the embattled staff say should be implemented to end the wrangling.

“It is a matter of regret that so much is going on at Makerere, we are concerned, if I could be given a copy of the Rwendeire report, we will make a decision and there will be public hearings where you will appear,” she said.

Mr Kamunyu and other staff at the University are on suspension, taking half pay while others have up to four years unpaid forced leave.

They disagree with Prof Nawangwe’s management style, and have been advocating for pay raise and a better working environment.

Rwendeire Committee

Following incessant striking and financial woes at the university, President Museveni in 2016 appointed a Visitation Committee headed by Prof Abel Rwendeire (now deceased).

In its report, the Rwendeire Committee recommended sweeping reforms in financial and administrative management of the University but has since become a paper tiger.

Prof Nawangwe has been at loggerheads with staff, who he can now interdict and fire after an amendment to the University’s human resource manual sailed through, granting him sweeping powers over staff.

The embattled staff have since downed tools, amidst denials and contradictions by Prof Nawangwe who on Twitter claimed there was no strike by the University’s academic staff.

IGG stuck with report on staff changes at BoU

The Inspector General of Government (IGG) Justice Irene Mulyagonja is said to be stuck with a report that the committee instituted by President Yoweri Museveni wrote on the controversial staff changes at Bank of Uganda (BoU).

Sources say the report remains in the hands of Justice Mulyagonja because members have not agreed on recommendations to be send to Museveni for action, with some suggesting some of the recommendations were included in the report by the IGG without their knowledge.

Others say Mulyagonja and other two persons from her office-Justus Kaleebi and David Makumbi who are members on the committee appointed by Museveni don’t want any recommendation that favours BoU Governor Prof. Emmanuel Tumusiime-Mutebile owing to the fact that he openly castigated the IGG when she asked him to stay staff changes.

But one committee member said President Museveni has the final says on the recommendations to be made, though he added that he is waiting for the COSASE report so as to act, more so, the official said Museveni is interested in chasing away corrupt officials from BoU.

On February 7, 2018, the Bank of Uganda (BoU) Governor Emmanuel Tumusiime-Mutebile made staff changes in which he controversially dropped former executive director of bank supervision Ms Justine Bagyenda in favour of Dr. Tumubweine Twinemanzi who was recruited from Uganda Communications Commission (UCC).

“In order to advance the mission of the Bank of Uganda (BoU), and to enhance operational efficiency and effectiveness, the Governor BoU Prof. Emmanuel Tumusiime – Mutebile has today, Wednesday February 7, 2018, effected staff appointments and transfers at various levels of management,” Tumusiime-Mutebile said in a statement.

A female member of the committee told Eagle Online they first agreed that Tumusiime-Mutebile and his deputy Kasekende be removed from their positions for failure to handle critical bank issues but later some backtracked on the recommendation and instead opted for the two officials completing their term.

“The investigation revealed that some senior staff were allied to Dr. Kasekende while others where allied to Tumusiime-Mutebile. This is not good for an institution like BoU. That is why we recommended that both officials leave office as soon as possible so that a neutral persons are identified to replace them and put BoU back on track,” she said.

Another MP on Katuntu’s committee said it would be a disaster to sack Tumusiime-Mutebile and his deputy Kasekende. “It is better to let them complete their terms so that they are able to write handover reports that can guide their successors. The two have been running the show at BoU and you cannot just sack them immediately despite the controversies,” he said.

Tumusiime-Mutebile was first appointed to that position on 1 January 2001 and was re-appointed for a second five-year term on 1 January 2006. In December 2015, he was re-appointed for a fourth five-year term, effective 12 January 2016.

On the other hand, Kasekende joined BoU in 1986 and served in various capacities including the following: Director of Research Executive Director of Research and Policy and Deputy Governor. Though he later served at the World Bank and African Development Bank. In January 2010, Dr. Kasekende was re-appointed Deputy Governor of the Bank of Uganda, to serve for the next five years, which term was also extended as his boss got another term in 2016.

An insider in BoU who was shifted to another role against his will as the Governor made staff changes, told this news website that the staff camps created within the institution were responsible for the carelessness exhibited by staff in the performance their duties. “You are media and you saw that come out as MPs probed our big bosses,” he said adding that it was one of the reasons why some senior staff failed to write or hid reports on the closure of banks.

He added that about three top officials at BoU were hoping to replace Bagyenda but were shocked when the Governor Tumusiime-Mutebile instead brought a new face in the names of Dr. Tumubweine Twinemanzi who shares tribal roots with the Governor. The father Dr. Twinemanzi, Manzi Tumwine served at BoU Board as well. He was also minister in Museveni’s government. Those opposed to Dr. Twinemanzi’s appointment think he was favoured by the Governor. As such the Katuntu committee is also in dilemma whether to recommend to Museveni that the new executive director for bank supervision be sacked.

However, other sources say Dr. Twinemanzi exhibited good qualities for that position especially during parliament’s Committee on Commissions, Statutory Authorities and State Enterprises (COSASE). They say Abdu Katuntu and MP Anita Among who both spearheaded this committee want Dr. Dr. Twinemanzi to remain at BoU as he worked had to bring them hide den reports and other documents as they probed BoU on sale of banks.

Makerere law lecturers ask Prof. Nawangwe to withdraw suspension of colleagues

As the indefinite suspension of leaders of Makerere University Academic Staff Association (MUASA) and Makerere Administrative Staff Association (MASA), continues, over 20 lecturers from the Department of Public and Comparative Law have asked the Vice Chancellor Prof. Dr. Barnabas Nawangwe, to lift the suspension arguing that the move infringes on the freedom of association and academic freedom which are provided for in the Constitution of Uganda.

On December 21, 2018, Nawangwe suspended MASA Chairperson Bennet Magara and the association’s Secretary Joseph Kalema after the two individuals wrote to the University Secretary asking that the university’s management should not meddle in the affairs of the associations there. These were also suspended on alleged incitement of staff against Nawangwe and his allies. The two are employees in the Directorate of Internal Audit and Directorate of Human Resources respectively.

Nawangwe would further also suspend Dr. Deus M. Kamunyu, the MUASA Chairperson who is a lecturer in the Department of Forestry, Biodiversity and Tourism.

“We wish to state that every Ugandan has a constitutional right of freedom of speech, and expression and freedom of association,” they argue in the letter dated January 25, 2019. The freedoms, the lecturers say include freedom to form and join associations, or unions, such as trade unions, political parties and other civic organisations as expressed in the constitution.

They also refer to sections 68 and 93 of the University and Other Tertiary Institutions Act, 2001 which recognises the right of staff to form associations. They say Section 93 states that: “There shall be an academic staff association whose aims shall be to promote the academic and welfare interests of the academic staff.”

The group says the university managers have no basis to challenge the legality of MUASA and MASA since their existence is recognised by both the Constitution of Uganda and University and Other Tertiary Institutions Act, 2001.

Be of high moral standing – state House official tells staff staff

State House Comptroller Lucy Nakyobe Mbonye urged State House employees to be in responsible family relationships saying society expects them to be of high moral standing and responsible individuals as people serving the presidency

She said that State House staff need understanding spouses because serving the presidency involves a lot of time leaving much of family affairs to their spouses adding that staff at State House have no holidays, no weekends and no christmas as they work all time round.

She was speaking during the wedding reception of one of State House staff Nathan Ouma who married Milly Nalwanga at Uganda Catholics Management and Training Institute in Rubaga over the weekend. The couple had earlier exchanged their vows at Namirembe Cathedral at ceremony presided over by Bishop of West Buganda Rit. Rev. Katumba Tamale.

Nakyobe, however, cautioned State House staff against using the official assignments as excuse to evade family responsibilities saying amidst their heavy schedules, they should have time for their families to be able to raise responsible families the country will be proud of.

She also urged especially female members to always value their marriage and respect their husbands regardless of their social status saying roles of husbands and wives will never be substituted adding that those calling for gender equality should not confuse the competition for social space with the sacred institution of marriage which she said is constructed on legal instruments and as sanctified by God.

Uganda Premier League: Second round gets underway tomorrow

The second round of the 2018/19 StarTimes Uganda Premier League season resumes tomorrow, Tuesday 29th January 2019 with two games on the menu.

A rejuvenated Express travel to Buhinga with four of their five new signings in line to make their debuts. Brian Umony, Sadiq Ssekyembe, Goffin Oyirwoth and Ivan Ocholit were named in the 21-man squad while Frank ‘Zaga’ Tumwesigye misses out due to uncompleted paperwork after his six months loan move from Vipers.

Wasswa Bbosa will face his former employers when his Tooro United FC side entertain the Red Eagles in FortPortal. The reverse fixture at wankulukuku ended in a 2-0 win for Express. Eric Kambale and Ibrahim Kayiwa were the goal scorers.

Express completed the first round in 8th with 21 points, one ahead of Tooro and will seek to make it four points.

In the other game of the day, Police will host relegation-threatened Nyamityobora at the StarTimes stadium in Lugogo.

Juma Balinya will hope to continue with his form he enjoyed in the first round of the season as well as Ruben Kimera and Johnson Odong to help Police.

The Cops won this fixture in the first round 2-1 at Wankulukuku. Police sit 8th on the table with 21 points while Nyamityobora are third from bottom with 9 points.

There will also be two games to be played on Wednesday 30th January, two on Friday 1st February and two on Saturday 2nd February in the matchday 16 fixtures.

KCCA FC finished the first round on top of the table with 36 points, 5 points ahead of top challengers Vipers SC who dropped points against URA FC and Mbarara City drawing both fixtures 1-1.

The Kasasiro boys will begin with a trip to Kakyeka stadium on Wednesday 31st January against Mbarara City while Vipers SC will get the second round of the league underway at home against Kirinya Jinja SSS on Friday, 1st February 2019. Both these fixtures ended in goalless draws in the first round.

Bright Stars will host Onduparaka FC at Champion Stadium Mwererwe while There will be a bottom of the table clash that will see Ndejje University travel to West Nile to face Paidha Black Angels at the Green Light stadium.

Meanwhile, the secondary registration window for the new signings will close on Thursday, 31st January.

The league is expected to end on May 4th, 2019 to give ample time for the Uganda Cranes to prepare for the 2019 Africa Cup of Nations in Egypt.

COSASE PROBE: Mpanga exposed in the new revelation by blogger Seruga as he asks Dfcu to fund fake social media campaign

Invisible spot on blogger Titus Seruga has released a payment voucher allegedly from Af Mpanga/ Bowmans to Dfcu bank asking for release of money to fund what they termed ‘fake media campaign.
Bowmans is managed by AF Mpanga as a country Managing Partner in charge of Uganda.

The invoice raises more questions and credibility issues as far as Mpanga is concerned because in In December 2017, the Commercial Court disqualified Mr Mpanga, together with another city advocate Mr. Kanyererezi Masemmbe of MMAKS Advocates from Sh397b Crane Bank Limited and Sudhir Ruparelia’s case against Bank of Uganda (BoU), citing conflict of interest.

In his ruling delivered on December 21, 2017, the head of the commercial court division, Justice David Kutosi Wangutusi stated that David Mpanga of A.F. Mpanga Advocates and Timothy Masembe of MMAKS Advocates acted in violation of the Advocates (Professional Conduct) regulations.

Section 4 of the regulation provides that an advocate shall not accept instructions from any person in respect of a contentious or non-contentious matter if the matter involves a former client and the advocate as a result of acting for the former client is aware of any facts which may be prejudicial to the client in that matter.

Sources have revealed that Mpanga and two journalists plus a host of operatives are supposed to propel fake news campaign for the Dfcu bank especially as they plan to get meet with parliamentary Committee on Commissions, State Authorities and State Enterprises (COSASE).

Last Friday Eagle Online revealed that Dfcu Bank and a lawyer from prominent city law firm are said to be planning to set up Sudhir Ruparelia’s son Rajiv Ruparelia for purposes aimed at gathering information that the can use against the Ruparelia Group which is a holding company for various companies such as Meera Investments, Crane Services Management (CSM) and former Crane Bank Limited (CBL) among others.

In one of the leaked discussions between David Mpanga of AF Mpanga advocates, and other two people, the discussion is centred around a yet disclosed amount of money from Mpanga to allegedly fight bad/fake news campaign and also reportedly access Mr. Rajiv for a set up recordings that could be used against him.

The bank and the said law firm have lined up some news operatives to trick Rajiv into interviews so as to extract information that could be useful to Dfcu bank in case of pending court cases involving the two sides. According to the leaked discussion, the plan also involves recording Members of Parliament especially those on COSASE. Dfcu is the financier of the campaign while Mpanga is supposed to dig up old files and write articles involving the transaction he had with Sudhir while he still represented him.

In February 2018, CSML dragged Dfcu bank to the Commercial Court demanding that the bank pays it rent worth Shs5 billion.
The bill accumulated after Dfcu Bank occupied 13 properties around the country but later vacated some without paying a single penny in terms of rent one year down to the road.
On some properties where rent was prepaid, Dfcu did not bother to meet any of its obligations and continued occupying the premises till they elected to vacate the premises at the end of April 2017.

DFCU Bank also vacated the properties without serving the three months’ notice as stipulated in the contract was tantamount to breach. In so doing, Dfcu Bank was walking out of long term fixed rental contracts without renegotiating them.
In another rental agreement Crane Bank rented 38 apartments for staff on Plots 22, 24, 26 Kampala Road at a monthly Shs53, 928,000. The contract was fixed for five years with a 7 per cent interest. By the time Dfcu vacated the premises in April 2017 without renegotiating the contract, the unexpired period on the contract made them liable for Shs2, 873,246,953.

In the case of Mbale Branch, which Crane Bank was renting for US$8,361.77 per month, Dfcu left two months rental arrears and an unpaid three months’ notice period, altogether being liable for US $27,678.01?
“The defendants said nonpayment of rental arrears has not only caused the Plaintiff losses, deprived it of use of its money and interest, caused it more suffering and grave inconvenience, but it has also adversely affected the Plaintiffs’ businesses for which the Plaintiff claims general damages,” CMS’s suit reads in part.

CMS says that Dfcu has been notified of their grievances and demand notices sent to them but they have blatantly refused to pay up.
On top of $385,728.54 and Shs2, 998, 558,624, CMS has prayed to court to also grant it interest on the aforementioned sum at prevailing commercial rate until the arrears are cleared.
On the other Eagle Online understands DFCU Bank and the said law firm have tried to bribe the Parliamentary Committee on Commissions, Statutory Authorities and State Enterprises (COSASE) after it emerged that Dfcu bank bought CBL without following the proper due process. This was during the probe of the Bank of Uganda (BoU) senior staff.

Dfcu bank bought off CBL at Shs200 billion paid in installments even as BoU claimed to have sunk Shs478 billion in CBL during the takeover period that happened between October 20, 2016 and January 25, 2017. Unfortunately BoU has failed to account for this money.
It emerged also emerged that BoU sold CBL to Dfcu bank well knowing that Bank of Uganda Staff Retirement Benefits Scheme owns has 0.59 per cent shares in the bank which is a conflict of interest. Some of the documents relating to the sale of CBL are nowhere to be seen as MPs on COSASE found out.

That aside Rajiv in October 2018, threatened to sue Dfcu bank for publishing his mobile number in the press without his consent, adding that it caused enormous inconvenience to him. Rajiv wanted an apology from the bbank took it over.
Earlier Dfcu bank had threatened to sue Rajiv for allegedly spreading malicious propaganda against it using some media houses. Dfcu claimed that the propaganda aimed at collapsing it. But Rajiv has rubbished the accusation since no evidence is available to pin him.

Police to file an appeal against the acquittal of Ivan Katongole and two others

Police is set to file an appeal against the acquittal of Ivan Katongole, a businessman dealing in fish maws at Kasenyi landing site in Katabi town council in Wakiso District, Andrew Kizito and Hellen Nabaggala.

The trio were Last week acquitted of all murder charges when they appeared before Kampala High Court Judge, Wilson Kwesiga.

The three were arrested early in 2017 and tried before Entebbe Magistrates Court before being committed to High Court in May that same year over the death of one Rose Nakimuli, a hairdresser in Entebbe, Wakiso District.

In his ruling, Justice Kwesiga said police failed in its investigative role and blamed Directorate of Public Prosecution’s offices for proceeding to charge suspects with the cases yet they knew that they have no evidences.

“Prosecution acted in bad faith because they knew they had no evidence to pin suspects but went ahead and charged them with the offences which was a wastage of time and resources,”

Speaking at Naguru police headquarters, Fred Enanga said, they are going to review all grounds under which the acquittal was made and subsequently file an appeal against court’s decision.

“We have experience for example under Kato Kajubi case where the sitting judge blasted police for inadequate investigations but at the end of day we filed an appeal the led to his conviction and sentencing,” he said.

Enanga said the incident should not discourage family members saying they have two weeks to file an appeal and police will do everything possible for conviction and sentencing of both suspects.

police intensifies anti female genital mutilation operations in Kween district

The police in Sipi region, has intensified its operations in Kween district after charges 18 for aiding and abetting female genital mutilation (FGM) in the area.

According to police spokesperson Fred Enanga, the charged persons include a 50 year old ring leader Irene Cherop a resident of Kongilel village, Kaptum sub county in Kween district. The group was arrested, after police foiled their plans to conduct FGM activities in the village.

“We have noted that the recent cases of FGM stem from a concept of family honor, where only mothers who had undergone FGM, were deemed suitable to grace the male circumcision ceremony of their son’s in 2018. As a result mothers started allowing their daughters to undergo FGM as a way of protecting their future,” Police Spokesperson Fred Enanga said at police Naguru police headquarters.

He said there is further efforts to trace for victims in three various villages of Kwoser, where seven girls where allegedly circumcise and Binyiny where more seven girls are averred to have been gone through the illegal cultural practice.

“The police is committed to fighting FGM, and the successful prosecution of the perpetrators including parents, husbands and victims who mutate themselves, will act as deterrents,” he said.

Mr. Enanga said they have established contacts with influential community members and other stakeholders to challenge the practice, tasked teachers, health and social care professionals to report cases of FGM once established in the course of their duties in schools and hospitals.

Gov’t does not have money to recruit more judicial officers –Museveni

President Yoweri Museveni has revealed that government does not intend to recruit more judicial officers due to lack of resources to facilitate them in the execution of their duties.

Museveni’s remarks followed Chief Justice Bart Katureebe’s a point of concern that, there is a lot of case backlog which he said was due to under staffing, poor pay and lack of finance to facilitate all the activities of the judiciary.

Katureebe said he continues to receive reports of corruption at different levels, adding that what remains true is that corruption in whatever form undermines the efficiency of the judiciary.

“When you talk about under staffing, you are not the only ones. Look at our police, if we choose to increase the man power in all sectors, we shall have no money to do other things and in the end, we shall have a crisis,” Museveni said during Judicial officers conference held at Serena hotel.

Museveni said, according to the world policing standards, Ugandans should have one policeman for every 500 peopl, he however, said Uganda with the population of over 40 million people, the country needs a police force of 8000 but currently has only have 430.

“I support the idea of enhancing salaries of judicial officers because their role in society is crucial. We shall do it in tandem with the improvement of the economy. You cannot convict me that I only pay salaries and leave roads, electricity and other services, I can’t agree because it is suicide. We should work according to the need of society as opposed to one who is near the pond,” he said.

Under the theme ‘Integrity and Accountability’, judiciary has also launched electronic payment and toll free customer feedback numbers, a strategy aimed at tackling various challenges and softening the operations within the judiciary.

The toll free numbers are 0800111900 and 0417892900, under this strategy, toll free lines are intended to improve on the Judiciary’s accountability through consistent provision of accurate information.

With the e-payment system, judiciary will partner with Uganda Revenue Authority, pay way machines, mobile money, and commercial banks to pay court fees.

South Sudan to host its 2019 international fixtures in Uganda

South Sudan’s Football Association (SSFA) has announced that the country’s national teams will host all their 2019 international matches in Kampala, Uganda.

It comes after the national stadium in Juba began reconstruction work on Saturday, which could take up to a year to complete.

According to BBC Sport, Francis Amin, the SSFA President said, “It is cheaper and nearer for us to play in Uganda than moving to Khartoum in Sudan.

“Besides, we also have several South Sudanese who stay in Uganda and can always come to cheer the teams,” Amin added.

Delegates from football’s world body were in Juba to oversee the start of the renovations, which are being aided by a Fifa development programme.

Amin said South Sudan’s shift to Uganda for ‘home’ matches would start in March when they are scheduled to host Tunisia in a 2019 U-23 Africa Cup of Nations qualifying match which also serves as an Olympic qualifier.

He said they will also be organising several international friendly matches in 2019 which will also take place in Kampala.

South Sudan achieved independence from Sudan in 2011 and was voted into full membership of Fifa at the world body’s annual congress in the Hungarian capital Budapest in 2012.
