ICC hands 18-year to DRC’s Bemba

Jean-Pierre Bemba, a former vice president of the Democratic Republic of Congo, was sentenced on Tuesday by the International Criminal Court (ICC) to 18 years in jail for crimes committed by soldiers who were under his command in Central African Republic over a decade ago.

“The chamber sentences Mr. Jean-Pierre Bemba Gombo to a total of 18 years’ imprisonment,” said judge Sylvia Steiner, ruling that his soldiers had carried out “sadistic” rapes, murders and pillaging of “particular cruelty.”

ICC prosecutors had urged that Bemba be imprisoned for at least 25 years, saying such a sentence would be justified by “the gravity of the offenses committed by Mr. Bemba and his degree of culpability.”

Bemba’s lawyers, for their part, had called for him to be released, pointing out that he had already spent eight years in jail before and during his trial.

The trial opened in November 2010.

Campaign of rape and murder

Bemba was found guilty in March on five charges of war crimes and crimes against humanity committed over a decade ago in the neighboring Central African Republic.

The Congolese rebel leader had sent his private army, called the Congolese Liberation Movement (MLC), to CAR from October 2002 to March 2003 to put down a coup attempt there against former President Ange-Felix Patasse. The ICC found Bemba guilty of having let his troops rape, murder and pillage across the country.

Bemba is the highest-ranking official so far to be convicted by the ICC, which was set up in 2002 as the world’s only permanent war crimes court. The court has only sentenced two other people before him: former Congolese warlords Germain Katanga and Thomas Lubanga.

His trial was also the first at the court to focus on rape as a weapon of war. Bemba has been charged among other things with failing to prevent gang rapes of men, women and children by some of his 1,500 soldiers.

In addition, he is the first person to be convicted by the court for crimes carried out by his subordinates.

Defense appeal

Bemba’s legal team gave notice late on Monday that the former vice president would appeal his conviction.

“The appeal will not be limited… to criticism of the trial chamber’s findings, but will also allege that in material respects the whole trial process was flawed and unfair and that Mr. Bemba’s rights as an accused were violated throughout,” defense lawyer Peter Haynes said in a filing to the court.

Bemba’s lawyers have constantly claimed that he is being held responsible for actions by some of his soldiers that he had no way of controlling.

Reading out the sentence on Tuesday, judge Steiner rejected their claim that Bemba was not answerable for his soldiers’ actions.

“Mr. Bemba’s failure to take action was deliberately aimed at encouraging the attacks directed against the civilian population,” she said, saying he had done “more than tolerate the crimes as a commander.”

Bemba, who after the CAR conflict served as one of four vice presidents in the transitional government of President Joseph Kabila, was arrested in Brussels in 2008 and handed over to the ICC.

He had fled to Belgium in 2007 after losing to Kabila in a presidential run-off the year before.

The former rebel group MLC has in the meantime become the Democratic Republic of Congo’s second-largest opposition party, which is still led by Bemba.

Burundi threatens to quit ICC

The International Criminal Court launch of preliminary investigations into post-election killings in Burundi hasĀ triggeredĀ threats from the country on reconsideration of membership to the Rome Statute.

Foreign Affairs Minister Alain Nyamitwe said ICC prosecutor Fatou Bensouda had not taken into account the principle of complementarity, where national courts are given the first priority to investigate the killings that have taken place in Burundi since April last year.

The principle of complementarity states that national courts are empowered to investigate and punish perpetrators of crimes against humanity and genocide and that the ICC can only investigate if the national courts are not able to, or if the UN Security Council asks for its participation.

Mr Nyamitwe said Burundi is yet to decide on its membership of the ICC but ā€œshould the ICC not respect what the African Union has been asking for, then we have no choice but to follow what others in the continent have come up with as an alternative.ā€

Members of the African Union have backed a Kenyan proposal to push for withdrawal from the International Criminal Court, saying it unfairly targets the continent.

The African Union made a resolution to reject the trials of sitting heads of state and senior government officials at the ICC and has instead proposed to expand the jurisdiction of the Arusha-based African Court of Human and People’s Rights to include international crimes.

Ms Bensouda recently warned that those alleged to be committing crimes that fall within the jurisdiction of the ICC could be held individually accountable.

Since violence erupted in April last year following President Pierre Nkurunziza’s decision to run for a third term, more than 400 people have been killed and thousands have fled the country. International human-rights organisations have accused Burundi security forces of carrying out targeted killings of presumed opponents of the president’s third term.

Sudan’s President Omar al-Bashir is currently wanted by the ICC for crimes against humanity in the province of Darfur.Ā Because 34 out of Africa’s 54 countries have signed the Rome Treaty establishing the court, ICC supporters say they are obligated to apprehend President al-Bashir. However, he recently visited South Africa and Uganda, and neither of them arrested him.

MP faints after watching her 2 children perish in accident

Ugandans on social media and friends of Entebbe MP Rose Mary Tumusiime have paid tribute to her late herĀ grown daughterĀ Doreen Tashobya Tumusiime and employee Patrick Busingye who died as she watched.

The grief-stricken MP fainted and was rushed to Entebbe Hospital where she is currently admitted. The tragedy occurred a few meters away from where the MP was. She was heading to State House to witness the swearing-in of new ministers.

A heavy truck smashed the MP’s daughter and her younger brotherĀ who was carrying her on a bike.

Rose is now left with threeĀ surviving children. Sadly, she was widowed only recently, in 2014.Ā Ā  Her husband was the late Edward Gumizamu Tumusiime, NRM party stalwart in Entebbe, and former vice chairperson of NRM at Wakiso district.

Top US General reveals ā€˜worst enemies’

US Army Chief of Staff Gen Mark Milley

US Army Chief of Staff Gen Mark Milley has ranked four nations as the most dangerous to US national security: Russia, China, Iran, and North Korea.

Though there was no definitive ranking of these nations, he stressed that Russia is number one.

Russia

It is the only country that is ā€˜literally an existential threat’, Milley said at an Association of the U.S. Army breakfast, adding that Russia can physically destroy us. In addition, the country has postured itself as an aggressive state over that last several years.

Rebecca Zimmerman, an associate policy analyst with RAND Corporation, said that what Russian President Vladimir Putin is doing is referred to as ā€˜measures of war’, operating in a way that stops short of requiring U.S. military response, but not by much.

Milley cited the country’s response to Crimea, the attack on Georgia, and the increase in defense spending on modernization efforts as posturing. He also suggested that Russia is invading sovereign nations in a way that has not been seen since 1945.

China

Milley suggested that while Russia is aggressive, China is ā€˜assertive’.

While its Navy has begun exploring disputed waters, the country has made no attempts to venture into other sovereign nations. In addition, the China is not our enemy … yet.

“I would caution anyone from saying China is an ‘adversary,'” he said.

The issue is the long-term potential. Its economic growth and increasing military power suggest a steady rise, and may indicate a major power shift, which could be dangerous in the future.

Iran

Though Iran seems to be compliant with the terms of the 2015 nuclear deal, the nation still remains a question in the minds of the security community.Ā  The Waall Street Journal recently reported that old uranium particles found at a base in Iran suggest President Hassan Rouhani was lying when he said that there were no plans to acquire nuclear weapons.

Though he did not dwell on the topic,Ā Milley said, “There’s no doubt Iran is a malign actor.”

North Korea

Yes, everyone knows it has a small military, petulant leader, and is a resource-depleted country. But North Korea does have nuclear capabilities. All four characteristics make for an unstable nation with very little to lose. Plus, North Korea is backed by China in most instances.

Though the threats of nuclear destruction have all proven to be empty words said by paper tigers, that doesn’t mean they always will be.

According to Milley, “just because it didn’t happen before is not a guarantee it won’t happen tomorrow.”

Lawyers urged to back EA integration

The legal fraternity should play a key role in sensitizing citizens on the integration process, EALA Speaker, Rt. Hon Daniel Fred Kidega has said.

The Speaker made the remarks in Arusha when he met with representatives of the East Africa Law Society (EALS) at the Speaker’s Chambers. The delegation paid the EALA Speaker a courtesy call to introduce the incoming Chief Executive Officer, Mr John Patrick Okoth.

The Speaker challenged EALS to work with Partner States to ensure speedy realization of approximation of national laws to the Community Acts.Ā Ā  He cited the full implementation of the Common Market Protocol as another area that should fully interest the legal fraternity.Ā  The Speaker further said it was important for EALS to spread its tentacles to the Republic of South Sudan, given its recent admission into the regional bloc.

ā€œWe need to enhance a symbiotic relationship between the legislative body and yourselves and to consult every so often on matters of legislation that improve the lives of East Africans,ā€Ā Rt. Hon Kidega said.

He said the Assembly would work closely with the EALS to ensure outstanding issues in the EAC Cross Border Legal Practice Bill, 2014 were addressed.

In attendance were EALS Programme Officers, Ms Brenda Dosio and Ms Lydia Taima Munganyinka.

The EALS CEO, John Patrick OkothĀ reiterated the regional law society had intensified its efforts in strengthening the integration process through advocacy around the EAC. He maintained this would be done while holding Partner States to account on matters of good governance, rule of law and human rights in accordance with the EAC Treaty.Ā Ā  Mr Okoth said EALS was ready for active and productive engagement with EALA and other stakeholders.

On her part, Ms Brenda Dosio, Programme Officer, Legal and Policy Analysis, said EALS would soon be reviewing its Strategic Plan to strengthen the institution and make it more robust, while Lydia Taima Munganyinka, Programme Assistant, Public Interest Litigation, lauded the Assembly for the role it continues to play in the integration process.

EALS has in the recent past referenced a number of applications before the East African Court of Justice (EACJ).

One of the cases pitsĀ the EALS Vs the Attorney General of Uganda and the EAC Secretary General and concerns what the Society calls human rights violations in Uganda during the ā€˜Walk to Work’ processions. A third case relates to the rendition of Kenyan citizens to Uganda with a view to defining the legal environment for combating transboundary crimes.
Mr Okoth who joined the EALS this month, has a rich background in both law and diplomacy. He is a former Deputy Ambassador of Kenya to the Netherlands and the Czech Republic. He was once Principal State Counsel in the State Law Office and the Department of Justice, in the Republic of Kenya.Ā  Within the diplomatic circles, Mr Okoth is fondly remembered at the Hague for his able handling of the renegotiations of the Treaty Establishing the Common Fund for Commodities among other accomplishments.

Mr Okoth who replaces Mr Tito Byenkya, is expected to steer the Secretariat of the regional bar association, as it redefines its role within the region through the development of a new Strategic Plan for the organization.

The organization headquartered in Arusha, is largest organized professional/ civil society dual membership organization in the region with a strong mandate and interest in the professional development of its members.Ā  Its membership spans to over thirteen thousand. The bar associations include the Burundi Bar Association (BBA), Kigali Bar Association (KBA), Law Society of Kenya (LSK), Tanganyika Law Society (TLS), Uganda Law Society (ULS) and the Zanzibar Law Society.Ā  EALS enjoys an observer status at the EAC.

Entebbe MP Tumusiime loses two children in boda accident

Newly elected Entebbe Member of Parliament Rose Mary Tumusiime has lost two children today, in an accident in Entebbe.

According to campus news website CAMPUSBEE,Ā Doreen Tashobya Tumusiime, a fresh graduate from Makerere Business School (MUBS) (together with her mother’s employee, Patrick Busingye) was this morning involved in a boda accident on her way to work.

A speeding Isuzu truck knocked her off a boda (which was being ridden by her brother, Patrick Busingye) splitting her head from the rest of the body around Muzinga park, near State House Entebbe. Tumusiime, who was self-employed was heading to her mobile money business station.

Boda accidents have become very frequent in this day and time as Doreen is the 3rd beautiful soul to lose her life to a boda accident after Juliet Tumwesigye and Charity Komuhangi.

May her soul rest in peace.

Ryan Giggs set to leave Manchester United to coach Nottingham Forest

The Manchester United great has been tipped to leave United following the departure of Louis van Gaal as manager.

Giggs had been assistant boss to Van Gaal for the past two years and it was widely expected he would eventually succeed the Dutchman.

But, after sacking Van Gaal in May, the United board overlooked the Welshman for the top job and opted to bring in Jose Mourinho.

Mourinho is understood to have offered Giggs a role in his backroom team but the 42-year-old is set to turn that down.

And, according to the Daily Mirror, Giggs is now ready to take on his first managerial role with Nottingham Forest.

The Championship side have been without a permanent boss since sacking Dougie Freedman in March.

Paul Williams was placed in interim charge following Freedman’s departure but left in May.

Should Giggs become Forest’s new boss, it will end a glorious 29-year association with United.

He is United’s record appearance holder, having played for the club 963 times, and is also their most decorated player.

Cranes start Comoros preparations in Mbale

On Monday, 15 players turned up for non residential training at the KCCA stadium in Lugogo

Milutin Sredojevic and the Uganda Cranes started preparations for their final AFCON 2017 qualifier match against Comoros Monday with the team training at the KCCA stadium in Lugogo for the upcoming Eastern Uganda regional tour.

Three foreign based players; Hassan Wasswa of Al-Shorta-Iraq, Emmanuel Okwi of SĆønderjyskE Denmark and Yassar Mugerwa of Orlando Pirates in South Africa Ā turned up for training ahead of the Eastern Uganda regional tour will take place on Saturday the 25th june, 2016 at Mbale Regional Stadium in Mbale where it will play the selected Eastern Regional Team.

According to Micho, the non-residential training will take place for the whole of this week up to Friday before the team sets off for Mbale that evening.

ā€œThe regional tour programme is an obligation to our national team sponsors. They will have us keep the players in shape ahead of the coming training sessionsā€ Micho noted.

Denis Iguma the versatile Uganda Cranes right back is suspended for the game against Comoros due to the accumulated bookings he got against Botswana both home and away in Francistown with the possible replacements being Uganda Cup winning skipper Nicholas Wadada (Vipers) and Joseph Nsubuga(Bright Stars).

The Eastern Regional tour is scheduled to take place till Mid-July.

An International Friendly Match on the 30th August 2016 against Kenya in Kampala at the Nelson Mandela National Stadium, Namboole will be the final match in the Cranes preparations calendar.
