Museveni calls for unity and development in Bunyoro

President Yoweri Kaguta Museveni, has called upon Bunyoro Kitara Kingdom and all its subjects to discourage forces of disunity for socio-economic development.

In his speech read by Prime Minister Robinah Nabanja at the 29th coronation ceremony of Omukama (King) Dr Solomon Gafaabusa Iguru on Sunday in Hoima city, Museveni urged Ugandans to embrace government programmes like Emyooga and Parish Development Model (PDM) to foster development.

He said the programmes are aimed at eradicating poverty amongst Ugandans.

 “The government has put in place many programs like PDM and Emyooga to eradicate poverty but this cannot be achieved when there is no peace in the country,” he said.

The 29-year-journey of Bunyoro Kitara Kingdom restoration is commendable for the transformation of lives by the NRM government that has seen many schools and hospitals for example constructed in collaboration with the kingdom.

“The government restored cultural leaders so that they can work together in harmony once handled well,” he said, emphasizing the need for unity.

Museveni also urged the BKK leaders and the people of Bunyoro to fight the foreign and unwanted behaviours of homosexuality.

The president contributed Shs50 million towards the 2023 Empango commemoration while the Nabanja contributed Shs10 million cash from her purse.

In his speech on behalf of the Omukama of Bunyoro Kitara Kingdom, the Okwiri (Chief Prince), Eng Fred Mugenyi Rucunya, congratulated the current Bunyoro Kitara Kingdom administration for promoting a good relationship with the central government.

He also said homosexuality was unwelcome to the kingdom saying it was also condemned by the forefathers as an unacceptable vice.

The Omuhikirwa (Prime Minister) of Bunyoro Kitara Kingdom, Mr Andrew Kirungi Byakutaga Ateenyi, said they are determined to promote peace, unity and hard work through supporting government programmes for the development of the people of Bunyoro.

Uganda’s Minister of Finance, Planning and Economic Development, Mr Matia Kasaija, appreciated the Bunyoro Kitara Kingdom administration for organising such a function that restores the subjects’ confidence into the kingdom, hence, promoting unity.

He tipped Banyoro, especially the youth, to focus on coffee farming pledging that the government is ready to support value addition for development.

Uganda’s First Deputy Prime Minister and also Minister for East African Community (EAC) Affairs, Rebecca Alitwala Kadaga, congratulated the Omukama and the people of Bunyoro upon the commemoration saying that as a Musoga, she traces her ancestors from Bunyoro land.

The Attorney General of Buganda Kingdom, Godfrey Sserunkuma Lule, the Prime Minister of Tooro Kingdom, Mr Steven Kiyingi are some other high-profile dignitaries that attended the ceremony.

MILAN– Flamboyant tycoon-turned-Italian premier Silvio Berlusconi has bowed out, aged 86. The self-made billionaire pioneered the use of wealth and media to achieve political power. Though his Forza Italia party and business empire are already weakened and unlikely to regain much prominence after his death, his unorthodox political methods spawned imitators across the West.

Italy’s four-time and longest-serving prime minister, who often quipped he would live until 120, passed away on Monday. He had been suffering with leukaemia and had recently developed a lung infection. To many, his name remains associated with “bunga bunga” sex parties, fake tan, bad jokes and financial scandals. Yet his entrepreneurial approach to politics has been copied by leaders including former U.S. President Donald Trump. Ex-British Prime Minister Boris Johnson also became popular by portraying himself as an eccentric outsider.

Of humble origins, Berlusconi acquired fame by building an empire that spanned at its peak real estate, broadcaster Mediaset, retailing and AC Milan soccer club. His pioneer spirit emerged in the 1970s when he started to challenge then dominant state TV broadcaster RAI. His aggressive use of advertising and cheap soap operas helped him create one of Europe’s biggest private broadcasting networks.

But it’s in politics that Berlusconi was most innovative. As Italy’s traditional parties collapsed under countless graft charges in the 1990s, he used his media popularity and image as a can-do entrepreneur to exploit Italy’s political void. While rivals and Western leaders looked down on his diplomatic gaffes, blatant self-interest and ebullient lifestyle, voters rewarded him with three electoral victories between 1994 and 2008.

Berlusconi’s ascent ended abruptly in 2011, when a spiralling sovereign debt crisis forced him out of office. It was downwards from there, with a tax fraud conviction compounding the assault his traditional broadcasters faced from digital rivals. In Italy, comedian Beppe Grillo outdid Berlusconi at his own game by using his personal brand and the internet to upend Forza Italia and other parties through his anti-establishment 5-Star Movement, which was the largest party in government between 2018 and 2021.

Despite controversy because of his closeness to Russian President Vladimir Putin, last year Berlusconi managed an unexpected comeback by siding with the victorious Brothers of Italy, led by Prime Minister Giorgia Meloni. But without an anointed political successor and the risk of fragmented ownership at Berlusconi’s family holding company Fininvest, both his party and his business empire are at risk. Shares in Mediaset’s successor MediaForEurope (MFEB.MI) were up 10% on Monday amid expectations the company could be sold. Meloni, whose hard-right group is Italy’s most popular party, will probably swallow up Forza Italia voters. And a plan to build a pan-European broadcasting champion has made little progress. Yet the mogul’s once unconventional methods have now gone mainstream, and his entrepreneurial approach to politics lives on.

Former Italian prime minister and broadcaster Mediaset founder Silvio Berlusconi died on June 12, aged 86.

Berlusconi had been suffering from leukaemia and had recently developed a lung infection.

Not giving up: Ham files application to stop impending court judgement in Shs 120b loan case against DTB Uganda and DTB Kenya

Kampala businessman, Hamis Kiggundu of Ham Enterprises has through his lawyer Muwema filed an application before the Supreme Court seeking to arrest an impending judgement in his Shs120 billion loan case against Diamond Trust Bank and Diamond Trust Bank Kenya.

Early this week, there was drama at the Supreme Court as Kiggundu dashes out of the courtroom protesting against what he termed as unfairness when Lady Justice Elizabeth Musoke who was handling the pre-trial of the case conference informed the two parties that there was no need for court to hear an application earlier filed by Kiggundu.

Lady Justice Musoke said whereas the parties were invited for a pre-trial, it was untenable since the court had heard the case and only awaits judgement that she said would be delivered on Tuesday June, 13, 2023.

This angered Kiggundu who accused the judiciary of being unfair.

Kiggundu’s new application

In his latest application, the businessman says when the appeal was heard by the Supreme Court in November, 2021 and parties directed to file written submissions and judgement set to be delivered on notice, his lawyers realised that DTB had admitted they illegally gave him a loan through his Ham Enterprises and Kiggs International, which made them to file an application seeking orders for judgement on admission by the DTB lawyers.

Kiggundu through his lawyers says that despite several requests to be heard, the court didn’t list the application for hearing until April 28 ,2023 when they were invited for a session of reconstitution of the panel on May 5, 2023.

“Upon receipt of the above invitation, the applicant through his lawyers wrote a letter on May, 2, 2023 requesting for the fixing and hearing of the earlier application but the court advised that the hearing of the said application would be communicated at a later date,” Muwema, Kiggundu’s lawyer said.

Kiggundu avers the court later introduced a new panel to sit in the judgement of the appeal since one of the panelists, Justice, Ruby Apio Aweri had passed on and the new panel consists of the Chief Justice Alphonse Owiny Dollo, Justice Faith Mwondha, Justice Percy Tuhaise, Justice Mike Chibita and Justice Stephen Musota.

He claims that it was unfair for both parties to be invited for a pre-hearing last week and Justice Elizabeth Musoke informed them she had orders from the head of the panel(Chief Justice) that the judgement in the case would be ready by June 13 and that his application was neither heard, allowed or dismissed.

He adds: “It is a grave injustice for the Supreme Court which is the highest court in Uganda to permanently lock the applicants out of an opportunity to be heard on such a novel and complex commercial dispute well knowing that is decisions are final, binding and not appealable.”

New evidence!

The businessman also says his team has got new evidence which would be crucial in determination of the case that he says court should allow him file before the judgement is delivered.

“In the meantime, the applicants recently discovered through Edwin Lubanga that the central Bank of Kenya, which supervises the banking industry in Kenya, did not grant the requisite approval under the law to the second respondent-DTB Kenya to enter into the disputed loan transaction which is the subject of this appeal,” Kiggundu says.

He avers that this information was not known by the time of filing and hearing of the appeal in 2021 which he says is very relevant to the substantial question of the illegal conduct of cross border financial institution business by DTB which he says is the subject of the appeal.

“The said information and evidence are not only credible but also capable of having an influence on the decision or result of the appeal.”

Kiggundu says it is only prudent that the new evidence is allowed by the Supreme Court since it is in the interest of justice, fairness and equity.

“There is no inordinate delay in filling this application which is very urgent in light of the impending judgement to be delivered in the appeal.”

Background

The pending judgment in the Supreme court stems from a series of legal proceedings initiated by businessman Kiggundu against DTB Uganda and DTB Kenya. The case originated from a syndicated banking agreement between Kiggundu’s Ham Enterprises Ltd and Kiggs International Ltd, and the two banks.

In October 2020, Commercial Court judge Justice  Henry Peter Adonyo ruled in favour of Kiggundu, ordering DTB Uganda to refund all funds deducted from his accounts. It was alleged that these deductions were made without Kiggundu’s consent. Records presented to the court revealed that Kiggundu had obtained loans totalling over Shs 120b from DTB Uganda and DTB Kenya between 2011 and 2016 to finance his real estate business.

The dispute arose when the banks claimed that Kiggundu had failed to fulfill his loan obligations, amounting to Shs 39 billion, as per the agreed terms. They threatened to seize the mortgaged properties. Kiggundu petitioned the Commercial court, arguing that the withdrawn funds exceeded the outstanding loan amount, as he had already made full repayment.

Kiggundu sought to deafeat  the banks’ defence and obtain an order for the refund of unlawfully obtained funds. Justice Adonyo dismissed the banks’ defence and directed them to refund the money, along with an 8 percent interest rate and the costs of the suit.

Justice Adonyo also ruled that DTB Kenya had transacted an illegal business in Uganda since it does not have a liecence, as stipulated in the Financial Institutions’s Act, 2004.

Not satidified with the ruling of Justice Adonyo, the banks sought relief from Principal Judge, Dr Flavian Zeija, who granted an order to stay the execution of Adonyo’s orders. This prevented Kiggundu from recovering the funds. Subsequently, the banks appealed to the Court of Appeal.

In a subsequent ruling, the Court of Appeal overturned justice Adonyo’s order and ordered a retrial before a different judge. Dissatisfied with this decision, Kiggundu lodged an appeal with the Supreme Court.

The Bank of Uganda, the Ministry of Finance and the Uganda Bankers Association (UBA) claim the loan transaction between Kiggundu and the two sister banks was legal, with BBA claiming that should Kiggundu be helped not to pay the loan, it would affect Uganda in terms of sourcing credit from foreign entities who offer syndicated loans.

Africa must unshackle itself from the epoch of neo colonialism

This Sunday I take an aim at America and it’s hegemony on Africa.I want to educate the African next generation how our continent has found itself where it is today . The manipulative history of America’s imperialism, aggression, meddling, sabotage, coup d’etats have led to plundering of Africa .

I am going to use the annals of history and declassified CIA documents that are available and that remind us of the loath, disgust and the bile with which they treated and continue to treat vibrant, ambitious and promising Africa leaders.

The coups in post colonial Africa were all manufactured against states that were perceived to be pro-Russia . Ghana got the first one in 1965. Uganda got a shocker in 1971 .The history of America systems helping the bloodletting brutality regimes , treacherous and frivolous framing of leaders and their eventual overthrow was nothing but infelicitous.

The heart breaking one was DRC which still bleeds . Look at what they did to Patrice Lumumba in Congo, even unfortunate is the ploy against Kwame Nkurumah in Ghana.

Despite their acknowledgment of his charisma and meritocracy as a leaders , they still deemed it fit to help to kill Patrice Lumumba and topple Nkrumah in the most disgraceful way.

According to the CIA declassified documents, they say “Kwame Nkrumah was a futurist, a born visionary. His plan as leader of Ghana was to make it an industrial hub within a generation. He dreamt of a united and successful African continent and the narrative he was creating for Africa was a foreign policy concern for the United States of America”.

In a Memorandum from the President’s Acting Special Assistant for National Security Affairs (Komer) to President Johnson, the coup that led to Nkrumah’s downfall was described as a fortuitous windfall because, “Nkrumah was doing more to undermine our interests than any other black African.

In reaction to his strongly pro-Communist leanings, the new military regime is almost pathetically pro-Western.” In other words, the military regime was a shadow of the West, a whole puppet show mistaken for governance.”

What sickened me is the level of celebrations .Astonishingly when this happened behind the iron curtain of intelligence secrecy, we had some Africans who ran to the streets to “celebrate” the fall of Nkurumah.

Little did they know that it was their own downfall in retrospect, an avalanche of coups and instability would follow later. Ghana was the second country to be destabilized by USA after they allowed the Belgians to kill Patrice Lumumba .

As this was happening in Ghana, hundreds of miles away in DRC, the CIA had connived with General Mobutu Sese Sseko and Patrice Lumumba’s head was eventually earmarked with a price tag.

What happened thereafter is what Congo has become today, a banana republic embroiled in a never ending cycle of chaos. In tracing these coups one finds himself unveiling hidden details of USA hallmarks in all African coups .

Why has Africa become so susceptible to the imperialist lies? It is sad that whoever stands objectively against USA hegemony in Africa is branded a “dictator” or a Communist sympathizer and brought down.

The truth remains that most of those who tried have saved Africa . Nyerere in Tanzania through UJAMA VILLAGES was able to bring his about a SOCIAL COBTRACT that no African nation has on the continent .

Whereas most of the good leaders in Africa whose only objective was to save Africa from the slavery and servitude were removed forcefully , the fact remained they educated Africa about the western hegemony.

The painful events of Libya that is still divided into two parts by USA and France is beyond human imagination . Muammar Gaddafi, Kwame Nkurumah, Patrice Lumumba and several others that have died, will be recorded as indeed the true “Messiahs”, that came to save Africa, but were frivolously framed by the West and betrayed by their own people . Hated abroad, and lynched back at home.

Libyan leader Muammar Gaddafi for example, left a LEGACY nobody in Africa will ever outmatch .It can be said that he had his flaws, but his collective pursuits were far bigger than his individual interests.

The curse his brutal murder has brought Libya and Sarkozy plus Obama and Cameroon who ordered the destruction of Libya is huge . This is strong enough testimony that the West will never allow any country to stand strong, especially from any part of the African soil.

Today in Libya there are laws, no virtue, and no government, just anarchy and endless perils. Africans are sold there, and their organs harvested for buyers in Europe, Asia and America. Libya has become a modern day slavery route and a conduit for human trafficking.

If history teaches us then let the Hillary Clinton see what she did in Libya . Gaddafi did not only have meticulous ambitions for Libya and Africa, but also practical on how to achieve them.

Libyan leader wanted an Africa that can trade with their own currency, Africa that can determine their oil prices, Africa that will sell oil with a gold currency, and one that can be free socially, economically, and politically.

For such lofty ambitions for Africa, Gaddafi knew he would one day pay a price for it, just like Lumumba and Nkrumah did pay with their lives . He made it clear to his people that the West would eventually come for his head, and later come for their oil, many in Africa thought it was a lie. Just visit Tripoli city today, a prophecy has been fulfilled in its exact form.

My article here tackles examples of American hand to keep Africa confused and disunited . I am not a communist but a scholar who wants history to be recorded .Gaddafi was the last man who wanted a free Africa, but was betrayed by his own people and killed in the desert like a dog by the West.

Unfortunately, as fate would have it, the remaining African leaders today are either SCARED or cowards , puppets of the West. Very few can obstinately stand to some of the U.S.A. machinations and the West. They don’t have a clue of what leadership is to a country, then to its people.

The AU through AUC has dampened our efforts for a United Africa .Very but a few of the Presidents or African Heads Of States, have a Pan-African vision . They sing Pan-Africanism on their lips in conferences while their bellies frost with imperialist goodies.

The AUC headed then by a French Mole Jean Ping was dumbfoundedly quiet and confused , and some leaders chose to be quiet and unashamedly forged an alliance with the West in the death of Gaddafi and Libya .

The danger of Africa is to be outspoken . Late Robert Mugabe was ridiculed, besmirched, isolated both home and abroad, he died a lonely man, today Zimbabwe is back to square one with bad opposition politics almost rocking the very existence of the country.

As I down my pen on this matter, I hope and pray that African leaders who will read this article especially those YOUNG ONES will put up a resource machinery to resuscitate and imbue Pan-Africanism for Africa’s sake.

The truth is tantamount if not manifest, that our overdependence in every aspect has robbed us not only proper leadership, but also a resolve for self determination. We are still in the SHACKLES OF IMPERIALISM .

Heroes Day: Museveni awards late Minister Engola, AIGP Abas Byakagaba

Former State Minister for Gender, Labour and Social Development, late Col Charles Okello Engola has been awarded posthumously the Masaba Star medal.

He was awarded during Heroes Day celebrations which took place this afternoon at Kasaala Catholic Parish Grounds in Butuntumula Sub-County in Luwero District.  The medal was received by the widow, Joyce Okello Engola.

He was awarded alongside Brigadier General Abdul Rugumayo, the deputy director of Chieftaincy of Military Intelligence who joined the National Resistance Army on July 20,1988. During the celebrations 45 people were awarded for their contribution to the development of Uganda.

Engola was on May 2, 2013 shot and killed by his bodyguard, Pte Wilson Sabiiti at his residence in Kyanja, a Kampala suburb. The killer fired several shots at close range before fleeing the scene up to the trading center where he entered a salon and shot himself dead.

Masaba Star Medal is awarded to Defense Forces personnel under the same circumstances described in the award of the Kabalega medal but where the gallantry is not as conspicuous as in the Kabalega medal.

Col. Engola joined the army in 1980 rising through the rank and file and was commissioned the rank of lieutenant in 1984. He later served as State Minister for defense and Minister for State for Labor and Industrial Relations.

While in the Uniform, he served in artillery with dedication, professionalism, passion and excellent ethics. He served in the artillery regiment at Lubiiri, Mbarara

He is described as a warrior with a revolutionary spirit, who was able to seize the operational initiative and dominate the battle space in northern Uganda, where he conducted successful counter insurgency operations against the Lord’s Resistance Army.

He was commended for commanding of UPDF 501 Brigade, headquartered at Opit, in Gulu District. The brigade played a role in fighting the Lord’s Resistance Army.

His daring sacrifices pacified his area of responsibility and enabled people to return to their homes to light fire and cook food. That is how he got the name Macodwogo and made him both a living legend and a darling of the people.

Canterbury Archbishop urges Kazimba to withdraw support for Anti-Homosexuality law

The Archbishop of Canterbury, Justin Welby has urged the Archbishop of Uganda, Dr. Stephen Kaziimba to withdraw his Church’s support for the Anti-Homosexual Act ratified by the President Yoweri Museveni at the end of last month.

The Archbishop of Uganda, Dr. Stephen Kaziimba, announced in May that his Church was “grateful” for the passing of the Act, which criminalises the “promotion” of homosexuality and introduces long prison sentences for offences, as well as the death penalty for “aggravated” offences.

In a statement released by Lambeth Palace, Archbishop Welby expresses his “grief and dismay” at the Church of Uganda’s stance, and outlines the arguments that he presented to Dr Kaziimba.

He reminded Archbishop Kaziimba that Anglicans around the world have long been united in our opposition to the criminalisation of homosexuality and LGBTQ people.

“Supporting such legislation is a fundamental departure from our commitment to uphold the freedom and dignity of all people. There is no justification for any province of the Anglican Communion to support such laws: not in our resolutions, not in our teachings, and not in the gospel we share.”

Dr. Kaziimba’s statement in support of the Act expressed his view that homosexuality was being forced on the Ugandan people “by outside, foreign actors against our will, against our culture, and against our religious beliefs”.

Archbishop Welby rejected Dr. Kaziimba’s stand saying, “I am deeply aware of the history of colonial rule in Uganda, so heroically resisted by its people. But this is not about imposing Western values on our Ugandan Anglican sisters and brothers. It is about reminding them of the commitments we have made as Anglicans to treat every person with the care and respect they deserve as children of God.”

Archbishop Welby refers to Resolution 1.10 passed by the 1998 Lambeth Conference. The resolution is often cited by conservative Provinces, since it rejects “homosexual practice as incompatible with scripture” and “cannot advise the legitimizing or blessing of same sex unions nor ordaining those involved in same gender unions”.

But the resolution also states that “all baptised, believing and faithful persons, regardless of sexual orientation, are full members of the Body of Christ,” and “calls on all our people to minister pastorally and sensitively to all irrespective of sexual orientation and to condemn irrational fear of homosexuals”.

Archbishop Welby says that he wrote to Dr. Kaziimba that he was “unable to see how the Church of Uganda’s support for the Anti-Homosexuality Act is consistent with its many statements in support of Resolution 1.10”.

He also referred to the 2016 Primates’ Meeting in Canterbury (before Dr. Kaziimba was installed as Archbishop), at which the Primates “condemned homophobic prejudice and violence and resolved to work together to offer pastoral care and loving service irrespective of sexual orientation”.

The Primates also reaffirmed their rejection of “criminal sanctions against same-sex attracted people”.

Archbishop Welby then addressed Dr. Kaziimba directly that these statements and commitments are the common mind of the Anglican Communion on the essential dignity and value of every person.

“I therefore urge Archbishop Kaziimba and the Church of Uganda a country and Church I love dearly, and to which I owe so much to reconsider their support for this legislation and reject the criminalisation of LGBTQ people,” Archbishop Welby urged.

And he challenges GAFCON and the Global South Fellowship of Anglican Churches, two conservative Anglican groups of which the Church of Uganda is a member, “to make explicitly and publicly clear that the criminalisation of LGBTQ people is something that no Anglican Province can support”.

Uganda to host Ministerial Conference on Durable Solutions for Refugees

Uganda in partnership with the Inter-governmental Authority on Development (IGAD) and the East African Community (EAC) are set to host a High-Level Ministerial Conference on Durable Solutions for Refugees.

Through the Office of the Prime Minister (OPM), a Conference will be held between 13 and 16 June 2023, at the Speke Commonwealth Resort Munyonyo, Kampala.

According to Esther Davinia Anyakun, the Minister of State for Refugees the conference is aimed at enhancing a coordinated regional approach to the refugee situation in the East, and the Horn and Great Lakes Region of Africa.

“The dialogue will focus on regional protection and solutions for refugees and host communities and explore ways to mitigate and address the drivers of displacement across the East and Horn of Africa region,” she said.

The Ministerial Conference is expected to produce a Ministerial Declaration and a common IGAD pledge that will inform the Global Refugee Forum (GRF) 2023 scheduled to take place in Geneva between 13 and15 December 2023.

She said IGAD-EAC Ministerial Conference on Durable Solutions for Refugees is one of the events Government and partners have organised to shape their positions and pledges to be presented in Geneva in December 2023

Uganda will co-convene the 2023 GRF together with Columbia, Niger, France, Japan, and Jordan. The co-convenorship is recognition of Uganda’s championing role in implementing the Comprehensive Refugee Response Framework.

She said Uganda has identified five areas that will be highlighted at the GRF – Livelihoods, environment and energy, transition management, localization, and durable solutions.

Gen Muhoozi condoles with UPDF soldiers in Somalia

Senior Presidential Advisor in charge of Special Operations Gen Muhoozi Kainerugaba, has condoled with Uganda Peoples Defence Forces (UPDF) Peace Keepers serving under the African Union Transition Mission in Somalia (ATMIS) over the tragic incident in Buulo Mareer which happened on May 26, 2023.

Meeting UPDF officers and men at base camp in Mogadishu, Gen Muhoozi said, “I have come to condole with you for the demise of our fallen combatants. Let us have a one-minute silence to pray for their souls. May their souls rest in peace and a quick recovery for the injured ones.”

Gen Muhoozi informed the peacekeepers that the strategic leadership has identified the weaknesses which caused Al-Shabaab to attack and overran the Buulo Mareer camp, saying these were both tactical and external factors that need to be addressed. He cautioned troops not to relax because of ATMIS drawdown but to instead be more aggressive.

He further noted that withdrawal operations if not well planned can cause a lot of damage than any other phase of the operation.

Gen Muhoozi cautioned troops of the dangers involved with hesitation. He said failure to decide in time automatically leads to death.

“In war, hesitation is very dangerous. It leads to death and eventual defeat. The survivors told me they expected an Al-Shabaab attack but they didn’t react until the enemy reached nearer and this broke command and control,” Gen Muhoozi said.

Buulo Mareer lies astride River Shabelle which is an agricultural sub region in drought-prone Somalia. Farmers irrigate their crops using tractors and donkeys throughout the night. This phenomenon led the troops to delay to react thinking the lights in the gardens were from farmers.

Gen Muhoozi Kainerugaba has been in Somalia for the last five days meeting UPDF commanders and staff, survivors of the Buulo Mareer incident and hospitalized troops at Level 11 hospital.

 He also visited the Somali State house where he met the President of the Federal Government of Somalia H.E Hassan Sheikh Mohamud.

Chaos in court as businessman Ham seeks justice to recover Shs 20b from DTB

The Supreme Court in Kampala turned chaotic as city tycoon Hamis Kiggundu demanded to be heard in his pending application to recover Shs120 billion from Diamond Trust Bank (DTB).

The session was going on well not until Justice Elizabeth Musoke declined to give a schedule for the hearing of the application filed by Hamis’s lawyer Fred Muwema.

“I was informed by the head of the panel in the main matter that the judgment is ready and it will be delivered on June 13, 2023.” Said the judge

Based on the above, Justice Musoke agreed with DTB lawyers led by Edwin Karugire that the application has already been overtaken by event since during the reconstitution of the panel both sides agreed that everything had been submitted.

“I would advise you to wait for the judgment of the court (full panel decision) which is ready.”

Having heard this, Ham moved out of court in protest and came in and asked the judge to be fair because this matter is not for only one individual but its outcomes affect many people once it comes out negative.

“The conduct of the applicant should be recalled. As lawyers we were not trained to come with hooligans in court, we can’t be intimidated by hooligans.” Lawyer Karugire submitted in court

However, counsel Muwema insisted that being a member of Court he will use all the available means to meet the head of the panel hearing the main case to have judgment of the matter postponed so as to fix time for this crucial application.

“Being that I didn’t talk about the application the previous time we appeared in court, it doesn’t mean that I abandoned it. We may have a weak case but we need to have our day in court.” Muwema added.

However, Ham expressed worry that this matter has gone too far to the extent that he is now under fear of what could happen to him as a result of this case.

All this happened under tight security deployment at court premises by both uniformed and non-uniformed personnel.

Next week, the panel consisting of Chief Justice Alfonso Owiny-Dollo, Percy Night Tuhaise, Faith Mwondha and Stephen Musota will deliver their judgment in this Ham – DTB matter which kicked off more than two years back from High court Commercial Division, it went to Principal Judge Flavian Zeija, Court of Appeal up to Supreme Court.

Supreme Court last week invited both parties for pre-hearing conference but as the two sides convened today for the said conference, of the Supreme Court judges informed that that there would be no pre-hearing conference to schedule the submissions of evidence by both sides as the judgement date had been already fixed for June 13,2023.

The never-ending legal battle between Businessman Hamis Kiggundu aka Ham and Diamond Trust Bank (DTB) has ignited a significant debate surrounding the independence of Uganda’s judiciary and the potential influence of politics in legal proceedings. The case, which centres on DTB’s admission of illegalities committed and documented on court records, has become a litmus test for the country’s legal structures and the judiciary’s ability to uphold the law.

At the heart of the controversy, concern has been raised about the political influence wielded by Attorney General Kiryowa Kiwanuka and his legal partner Mr Edward Karugire of Kiwanuka and Karugire Company Advocates with concerned individuals and legal scholars are questioning whether their positions and connections could potentially protect Diamond Trust Bank from the illegal actions it has admitted to committing.

The bank and its lawyers of K&K Advocates before the Supreme Court in 2021 and admitted failure of the Court of Appeal to address the substantial point of illegality in their submission of November 5,2021.

On November 11, 2021, Ham filed an application stating that DTB had concurred with him that the Court of Appeal (COA) justices; Richard Buteera, Christopher Madrama, and Kenneth Kakuru, did not address the issues of illegality contrary to the provisions of the financial institutions act on which grounds judgment was rightfully entered at the high court.

DTB and its lawyers, K & K advocates, have also admitted to the failure of the Court of Appeal to address the substantial point of illegality in their submissions. Ham Enterprises filed an application highlighting that the Court of Appeal justices did not address the issues of illegality as per the provisions of the Financial Institutions Act. As a result, the case now awaits a judgment on admission, while DTB remains entangled in the admissions it made on court records at both the high court and the Supreme Court.
