Court to rule on Kato Lubwama academic qualifications saga

EMBATTLED: Lubaga South MP Kato Lubwama.

The High Court is today expected to rule on whether to add Makerere University as a party to an application seeking to challenge the academic qualifications of Rubaga South MP Kato Lubwama.

Justice Margret Oguli Oumo is to deliver her ruling at 2:30pm at the High Court Civil Division.

Habib Buwembo, who dragged Lubwama to court for lack of the required academic qualifications to be an MP, asked court on Monday to add Makerere University as a party in his case.

Mr Buwembo wants Makerere University to avail him with policies regarding its mature age entry examinations so as to establish whether Lubwama sat and passed the exams before being admitted for a Diploma in Music, Dance and Drama in 1992.

He also accuses the University for failing to produce the Diploma Certificate it awarded to Kato Lubwama.

According to court documents, Buwembo contends that Kato Lubwama lacks the minimum academic qualifications to be a Member of Parliament and that he failed his Uganda Certificate of Education (UCE) examinations.

This allegation is further clarified by then Uganda National Examination Board (UNEB) Executive Secretary, Peter H Anywar, who says that having obtained result 7, Kato Lubwama did not qualify for the award of a certificate.

Having obtained such information from UNEB, Buwembo sought for the same at Makerere University, requesting for Lubwama’s certificate, a request the University turned down.

Buwembo’s lawyers argue that these documents cannot be accessed anywhere as he didn’t use them even on nomination day.

He just presented a letter titled ‘To Whom it May Concern’ to the District Returning Officer. It was written by the University’s academic registrar on 15th/October 2015, they add.

Museveni drops longest-serving PS Kabagambe Kalisa

DROPPED: Former Ministry of Energy Permanent Secretary, Dr. Kabagambe Kalisa.

Engineer Kalisa Kabagambe, the longest serving Permanent Secretary since President Yoweri Museveni came to power in 1986, has been dropped.

Evoking his constitutional powers under Section 174 of the Constitution, Mr Museveni named Professor Stephen Isabalija as the new PS for energy.

Prof Isabalija is the immediate former Vice Chancellor of Victoria University, and replaces Eng. Kalisa, who now becomes the Senior Presidential Advisor on Oil, Gas and Minerals. Eng Kalisa has been the energy ministry PS for over 25 years.

Other long-serving PSs dropped include foreign affairs’ James Mugume, who has been replaced by Ambassador Patrick Mugoya; and the Ministry of Agriculture PS Vincent Rubagumya, who has been replaced by Pius Wakabi; and Internal Affairs’ Patrick Kagoda, who has been replaced by Dr Benon Mutambi Mugisha. Bageya Waiswa, the PS of the Inspectorate of Government, has also been replaced by little-known Rose N. Kafeero.

Meanwhile, Education PS Dr Rose Nassali now moves to Judicial Service Commission (JSC), while Public Service Commission (PSC) Chairman John Mitala and his deputy Vincent Opio Lukoni, retain their offices. Other PSs who retained office are Lucy Nakyobe Mbonye (State House Comptroller); Christine Guwatudde (Office of the Prime Minister); Deborah Katuramu (President’s Office) and Catherine Musingwiire (Ministry of Public Service). Also announced was Dr Diana Atwiine, who was named the health ministry PS last week, replacing Dr Asuman Lukwago, who now moves to the Education Service Commission. Previously, Dr Atwiine worked as Head of the State House Health Monitoring Team.

The other notable appointees are from State House and these include Molly Nawe Kamukama, who becomes the Principal Private Secretary to the President (PPS) replacing Ms Mary Amajo, who now becomes Senior Presidential Advisor on Public Service; and Major Edith Nakalema, who has been elevated to become President Museveni’s Personal Assistant. Maj Nakalema is deputised by Maj Night Irikiriza.

EAC competition commissioners sworn in

The five newly appointed Commissioners of the East African Community Competition Authority (EACCA) have been sworn in at the EAC Headquarters in Arusha, Tanzania.

The appointed Commissioners were approved by the 33rd Meeting of the Council of Ministers held on February 29, 2016, which considered nominees submitted by each Partner State and appointed them as Commissioners of the EACCA.

The five Commissioners of the Authority include Mr Sam K. watasa (Uganda) Mr. Innocent Habarugira (Burundi), Mr. Francis W.  Kariuki (Kenya), Dr. Frederick Ringo (Tanzania) and Dr. Didas M. Kayihura (Rwanda).

Presiding over the function on behalf of the EAC Secretary General, the Registrar of the East African Court of Justice His Worship Yufnalis Okubo, congratulated the commissioners upon their appointment as the first Commissioners to serve the EAC Competition Authority.

“The onset of the EAC Common Market, coupled with our engagement in the globalized world implies that a higher percentage of competition cases have a significant regional and international ramification. The foregoing calls for the establishment of the EAC Competition Authority to regulate regional competition matters,” said the Registrar.

He urged Partner States to benchmark on international best practices in the enforcement of the EAC Competition Act 2006.

The Commissioners pledged their commitment to the Community by signing the Oaths of Allegiance and Secrecy, a formality and requirement delivered and witnessed by the EACJ Registrar Okubo, assisted by the Counsel to the Community Dr. Anthony Kafumbe, and Principal Human Resource Officer Ms. Ruth Simba, among other staff from the EAC Secretariat.

During their three-day inaugural meeting, the Commissioners considered the Authority’s draft internal rules of procedure which spell out how it will conduct its business, developed a work plan and EAC merger review issues.

The EAC Competition Act, 2006, among other things, seeks to allow consumers to take class action against goods or services providers. It also seeks to seal loopholes that enable trade associations and firms operating across the region to engage in exclusive agreements, or form cartels, forcing consumers to pay higher prices for goods and services.

Zim Minister in court as Mugabe succession battles intensify

EMBATTLED? Zimbabwe Higher and Tertiary Education minister Prof. Jonathan Moyo.

The Zimbabwe Minister of Higher and Tertiary Education Jonathan Moyo is expected to appear in court today, on charges of abusing Zimbabwe Manpower Development Fund (Zimdef) finances.

The development comes in the wake of Prof. Moyo handing himself over tardily to the Zimbabwe Anti-Corruption Commission (Zacc) yesterday, following accusations he and his deputy Godfrey Gandawa abused US$400,000 belonging to the Fund.

According to the media, following the Zacc exposé and the subsequent plan to arrest him during a Zanu PF politburo meeting last month, Moyo had steadfastly refused to submit to Zacc, citing what he called political, ethnic and factional persecution.

It is said he insisted Zacc was a kangaroo outfit and on Tuesday he accused the commission of being used by Vice-President Emmerson Mnangagwa to persecute him, as part of Zanu PFs factional fights in the battles to succeed 92-year old President, Robert Gabriel Mugabe.

Zacc spokesperson, Phyllis Chikundura confirmed that Moyo had gone to the commission on his own accord to give his account of what happened.

However, earlier on Tuesday, Moyo had released a damning statement, where he threatened to sue VP Mnangagwa, Information minister Christopher Mushowe and his permanent secretary George Charamba, Zacc commissioner Goodson Nguni, acting National Prosecutor-General, Ray Goba, and journalists from the State media.

Moyo contends that Mnangagwa was abusing Zacc and the Prosecutor-General’s Office to further his quest to succeed Mugabe.

In a related development, the Zanu PF recently named a committee headed by Jacob Mudenda to probe Moyo’s allegations that Zacc was being used to pursue a factional agenda.

Burundi threatens to withdraw from AMISOM

SET TO WITHDRAW: Soldiers of the Burundi National Defence Forces serving with AMISOM

The Burundi government has served notice that it could withdraw its troops from the African Union (AU) force fighting militants in Somalia, citing non payment of troops by the European Union to the tune of US$43.2 million dollars, as the main reason for the threat of withdrawal.

Burundi Defence Minister Emmanuel Ntahomvukiye, on Thursday told parliament that over 5000 soldiers had not received their monthly allowance, US$800 (£640) in arrears for 10 months, which is supposed to be paid by the EU.

The turnaround is surprising given that in March this year the Burundi government through First Vice President Gaston Sindimwibo, assured the Special Representative of the Chairperson of the African Union Commission (SRCC) for Somalia, Ambassador Francisco Madeira, that the Burundi troops will continue serving under AMISOM command along with other troop contributing countries.
“The First Vice President told me that they are determined to be with Somalia and to fight side by side with them come what may,” Ambassador Francisco Madeira, was quoted as saying in an interview then, shortly after the meeting VP Sindimwibo.

Meanwhile, the decision of the EU to cut off its funding for the troops is tied to the ongoing political crisis in Burundi.

Burundi is the second largest contributor to AMISOM, the AU intervention force fighting al-Shabab insurgents in Somalia. Their over 5400 troops come behind Uganda who have over 6000 troops.

Somalia is in the process of conducting its elections and the issue of security is high on the agenda. Recent withdrawals of troops by the Ethiopian government has led to the retaking of towns by al-Shabaab.

Ethiopia has flatly denied that the withdrawal of troops funded by their government is linked to internal anti-government crisis. An al-Shabaab leader however said recently that protests back home informed the move.

AMISOM troop contributing countries include Uganda, Burundi, Djibouti, Ethiopia and Kenya, while police contributing countries include Uganda, Ghana, Kenya, Nigeria and Sierra Leone.

South Sudan paid US1m for Machar aide arrest – Kenya opposition MP

Asman Kamama, an opposition Member of Parliament in Kenya has reportedly accused his country of receiving US$1m from the government of South Sudan, to effect the arrest and deportation of rebel leader Riek Machar’s spokesperson, James Gatdet Dak.

The South Sudan Tribune quoted sources saying Mr Kamama ‘believes that Juba government has paid $ 1 million for the arrest and deportation of the opposition spokesperson. The payment is also to track down other opposition (SPLM-IO) members residing in Kenya’.

If true, Mr Kamama’s allegations come in the wake of the deportation of Gatdet Dak who, on his Facebook page wrote that the SPLM-IO welcomed the sacking of the United Nations Mission to South Sudan (UNMISS) force commander, Kenyan Lieutenant General Johnson Mogao Kimani Ondieki.

It is believed that Dak’s post angered some politicians in Kenyatta’s government, with reports emerging that the Kenyan government has now turned down a request from the UN to name a replacement for Lt Gen Ondieki.

Through an investigation the UN admitted to the failure saying the malfunction of the mission was mostly due to poor command, with revelations that UNMISS failed to protect civilians and foreign aid workers in South Sudan’s Juba and Malakal cities.

Meanwhile, relatives said that Gatdet Dak was picked from his Nairobi home on Wednesday afternoon in what a appears to have been a coordinated operation organised by the special services of Kenya and South Sudan and taken to the airport where he was allowed to speak to some of his family members and relatives. The motive behind Gatdet’s kidnapping remains unclear and speculative.

But some people attribute the cause to the statement in which he welcomed the sacking of Lt Gen Ondieki, while others, some of who are high ranking members of the government, blamed the South Sudan government for engineering Dak’s deportation.

“This is a coordinated operation. The office of the president and the first vice president paid the money to the Kenyan government to execute this operation. They wanted James Gadet to be deported to South Sudan so that Riek Machar is denied an opportunity to speak to the outside world through his spokesman. This is the strategy employed by Taban Deng Gai. Now James Gadet is here. They brought him this afternoon. I saw at him at the blue house”, a highly placed source reportedly told Sudan Tribune.

No official statement from either the government of Kenya or South Sudan was made, with officials at the Ministry of Foreign Affairs and Office of the President declining to comment.

SPLM-IO officials speak out

SPLM-IO opposition officials in Addis Ababa said that Gatdet was flown to the capital Juba Thursday afternoon, after being held at Jomo Kenyatta Airport awaiting deportation.

Another official in the Office of the SPLM-IO leader’s office said Gatdet’s deportation came hours after SPLM-IO leader, Riek Machar, who is currently in South Africa for medical treatment, had early yesterday established contacts with the Kenyan authorities to set free his spokesperson.

Earlier, Machar had also contacted UNHCR officials as Nairobi prepared to deport Dak, who also is a United States citizen.

Opposition officials say Dak could be killed, prosecuted or subjected to different forms of abuses while in the hands of the Juba government.

Primary seven pupils have completed their Primary Leaving Examinations (PLE) papers today.

Among the students who sat this year’s PLE include musician Bebe Cool’s son, Alpha Thiery.

“Let’s wish my son ALPHA THIERRY SSALI success in his PLE. May Allah guide you,” Bebe Cool wished his son success on Wednesday.

Alpha’s mother, Zuena Kirema reiterated a similar message, “It’s a special month for the Ssalis because our baby Alfa Thierry is sitting for his PLE on 2nd and 3rd…All thanks to Allah because with His will & mercy all this has been possible. I also celebrate 10years of waking up every morning to get him ready and dropping him off to school…I know katandika butandisi.

Hollywood actor, Steven Seagal given Russian citizenship by Putin

President Vladimir Putin signed a decree to citizenship to the martial arts expert, Steven Seagal who starred in Hollywood action thrillers during the 1990s.

Seagal is a friend with Mr Putin, who he has described as “one of the greatest world leaders”.

Mr Putin’s spokesman said Seagal was known for his warm feelings towards Russia and his status as a famous actor was a reason to make him a citizen.

Seagal made headlines when he described Russia’s actions in Crimea, which it annexed in 2014, as “very reasonable”. A keen guitarist, he played a concert there the same year.

In 2013 Mr Putin reportedly proposed that Seagal be made an honorary consul of Russia in California and Arizona.

The move would have made Seagal a potential intermediary between the White House and the Kremlin, Buzzfeed reported. The US refused.

Seagal, whose grandmother was from Vladivostok in Russia’s Far East, has made frequent trips to Russia in recent years and visited Kamchatka and Sakhalin in September.

He said during the visit that he wanted to spend several months or a year in the country, Russia’s Tass news agency reported.

Seagal follows other celebrities including French actor Gerard Depardieu, US mixed martial arts fighter Jeff Monson, US boxer Roy Jones and US snowboarder Vic Wild in taking Russian citizenship.

Earlier this year Seagal was given Serbian nationality after offering to set up a martial arts school in the capital Belgrade.

The action star’s movie credits include Under Siege and Flight of Fury and he has also starred in his own US reality TV show, Steven Seagal: Lawman.

Apass loses out on Airtel deal

IN FIGHTING MOOD: Musician Apass

Dancehall musician, Apass was last year appointed Aitel Uganda’s brand ambassador.

However, his journey as the telecommunications representative hasn’t been that rosy as he has lived under the shadow of Eddy Kenzo, who is also an ambassador of the network.

Days after signing a contract with Apass, Airtel also took on Kenzo after he landed a nod at the BET awards. He went on to win the award thanks to Airtel that ran adverts across all media platforms calling for the public to vote for Kenzo.

Airtel would later that year sponsor his show. His closeness to Airtel despite him not being under any contract with the network proved it all, Apass’ exit from Airtel was imminent.

And as predicted by many, his reign came to an end this week.

“I would love to officially announce that I am no longer working with Airtel Uganda it has been amazing working with them and the whole team, I wish them the best in the future. Thank you Airtel I appreciate the times we shared.”

Social critic Frank Gashumba arrested

“I am not a factory, I do not sugarcoat anything; if you ask for my opinion, that is what you get…my head is not powered by anyone. If I was meant to be controlled, I would have been created with a remote control,” social critic Frank Gashumba fumed upon learning of a directive from Uganda Communications Commission (UCC) stopping Nation Television (NTV) from hosting him.

According to the directive, Gashumba is accused of using a language that UCC finds profane and abusive on radio and TV programmes where he appears as a guest.

“When did UCC become a complainant? When did UCC become an investigator, court and a judge? In any case if I had committed any crime in any of my submissions, I would have expected the Police to summon me! Who conducted the investigations that found that I was using an abusive language? And how come NTV that hosted me is cautioned and I the purported offender have not been cautioned!” he wondered.

Well, he has been arrested this morning and is currently being held at CID headquarters in Kibuli.

Apparently, the complaint in this case is Godfrey Mutabaazi, the Executive Director of UCC.
