Uganda Premier League to resume February 6

After the Cranes team dropping out of the CHAN tournament in Cameroon, the players’ focus now shifts to the StarTimes Uganda Premier League.

The league returns six days earlier than expected with two rescheduled fixtures to take place on February 6 and 9.

First, champions Vipers will host newly promoted MYDA on Saturday February 6 at St. Mary’s stadium, Kitende before they visit six time champions Express FC at Mutesa II stadium, Wankulukuku.

“The UPL Secretariat hereby reschedules earlier postponed match #8 Vipers SC Vs MYDA FC and match # 16 Express FC Vs Vipers SC as follows….,” reads part of the statement from UPL signed by CEO Bernard Bainamani.

The three teams Vipers, MYDA and Express are the only ones to have played less than five games when the league went into break.

Express sit 6th on the 16-team table log, Vipers are 8th while MYDA are 14th with 8, 7 and 1 point respectively.

Saturday 6th February 2021: Vipers SC Vs MYDA FC, St. Mary’s Stadium Kitende – 3:00pm.

Tuesday 9thFebruary 2021: Express FC Vs Vipers SC, Betway Muteesa II Stadium-Wankulukuku – 4:00pm.

More jobs for Ugandans as Ministry approves Premier Recruitment to export labour

The Ministry of Gender, Labour and Social Development has approved Premier Recruitment Limited’s request to export labour hence providing employment opportunities to Ugandans who want to work abroad.

According to a letter from Lawrence Egulu, on behalf of the ministry’s permanent secretary, they have evaluated and approved Premier Recruitment Limited to export 200 workers to the United Arab Emirates.

“This request has been evaluated and found to meet the requirements of the pertinent provisions of the employment (Recruitment of Ugandan Migrant Workers Abroad) Regulation, 2003 and Guideline 13.0 o the Guidelines on the Recruitment and Placement of Uganda Migrant Workers Abroad. 2015,” part of the letter reads.

“The purpose of this letter, therefore, is to infirm you that the (200) employment opportunities offered by TRANSGUARD GROUP 200 in United Arab Emirates have been posted and are advertised on our website.”

Premier recruitment is fully licensed with the Ministry of Gender, Labour and Social Development for both internal and external recruitment. It is a subsidiary of Ruparelia Group of companies.

2021 Elections: Over 80 polling stations results were not included in presidential final tally

The chairman of the Electoral Commission (EC) Justice Simon Byabakama has revealed that presidential election results of 83 polling stations were not included in the final tally.

On Thursday 14th January, 2021 EC conducted Presidential Elections where Ugandans exercised their constitutional rights of choosing a president who will lead them through a five year term.

Byabakama said Uganda has a total 18,103,603 registered voters and 34,684 polling stations. He said only 10,350,819 people turned up to vote.

According to the EC, the excluded polling stations had 54,357 registered voters, a number which could not affect the final results. The presidential election which comprised 11 candidates was won by President Yoweri Museveni Tibuhaburwa Kaguta who got 6,042,898 (58.38%). His closest opponent Kyagulanyi Robert Sentamu got 3,631,437 votes (35.08%).

“The difference in votes obtained by the leading candidate and first runner up would not have a significant effect on the final results even if all the voters from the polling stations were added to the first runner up,” Justice Byabakama said.

The excluding of the results is alluded to allegations of ballot stuffing which gave rise to violence and destruction of the voting materials, grabbing of polling materials during the polling process and total votes cast exceeded the number of registered voters for the polling stations.

He decried of violence exhibited at various polling stations and urged police to investigate allegations of Uganda Peoples Defence Forces (UPDF) officers who were captured ticking ballots.

“The Electoral Commission wishes to congratulate the people of Uganda on exercising their constitutional rights and participating in the Presidential and Parliamentary Elections held on 14th January 2021, and the Local Government Councils elections held to date,” he said.

Court upholds Muhammad Nsereko’s victory in Kampala Central

Mengo Court Chief Magistrate Esther Nansambu has dismissed Bobi Wine’s brother Fred Nyanzi Ssentamu petition calling for recounting of votes of 50 Polling stations gazetted in Kampala Central constituency.

On Tuesday, Sentamu petitioned Mengo Magistrate’s Court calling for recounting of votes in 50 of the 120 Polling stations in Kampala Central.

Muhammad Nsereko was declared winner after garnering 16,998 votes as his closest opponent, Nyanzi polled 15,975 giving a difference of 1,022 votes. Nsereko is the only MP who won the election in Kampala with the rest being won by National Unity Platform (NUP).

Through his Lawyers led by Anthony Wameli, Nyanzi averred that the electoral process was marred with malpractices and alterations of results. He told the Court that his client’s agents were threatened and chased away from polling stations.

Nyanzi contended the Electoral Commission connived with Nsereko to alter and manipulate results recorded on many of the Declaration of Results Forms.

Parliament foils Finance Ministry’s scam of recapitalizing Bank of Uganda

The parliamentary Budget Committee has foiled a scam in which the taxpayer stood to lose at least Shs481 billion in the alleged recapitalization of Bank of Uganda (BOU).

The money was discovered during an interaction between the Ministry of Finance and the Budget Committee to scrutinize the Financial Year 2021/22 budget framework paper.

While appearing before the Budget Committee of parliament on Wednesday. BoU’s Deputy Governor Michael Atingi-Ego said the Central Bank does not need recapitalization in the 2021/2022 financial year.

Atingi-Ego was appearing on the request of the committee to clarify on the Shs 481 billion request in the Budget Framework Paper for the 2021/2022 financial year towards the recapitalization of BoU for the second consecutive year.

During the budgeting cycle for the 2021/2022 financial year, the Finance Committee approved a request of Shs 481 billion to recapitalize the Central Bank.

This request triggered suspicion among legislators with the committee chairperson, Henry Musasizi, saying it could be a plot by the government to siphon funds under the guise of recapitalizing the Central Bank.

Musasizi disclosed his suspicion during an interface between the Budget Committee, Finance Ministry and National Planning Authority led by the Finance Minister, Matia Kasaija on Monday, 25th January 2021, over the budget estimates for the next financial year.

Musasizi explained that recapitalizing BoU would not be done through appropriation of cash from the Consolidated Fund but rather from the securities issued by the treasury. Approached with a fresh recapitalization request, MPs questioned whether the Finance Ministry was using the item of recapitalization to fund items hidden from parliament’s scrutiny.

Asked for an explanation on Monday, Kasaija said just like any other bank, the Central Bank is required to maintain capital holding above a certain threshold and therefore the government couldn’t risk allowing BoU to fall below the threshold.

However, MPs were shocked when the BOU Deputy Governor, Dr. Michael Atingi-Ego told legislators that the capital of the bank is not impaired and therefore no need for recapitalization.

“The procedure for recapitalization is that once the audited accounts for any financial year have been finalized, then the level of capital is determined…whether the capital is impaired or not. Should the capital be impaired, then it is only at such a point when Bank of Uganda requests the Ministry of Finance to present to parliament a request for recapitalization,” said Atingi-Ego.

He recounted an incident in the 2018/2019 financial year when the capital of Bank of Uganda was impaired by Shs 481 billion and a request was made to the Ministry of Finance for recapitalization, which was approved in July 2020.

Atingi-Ego told the Budget Committee that the accounts of Bank of Uganda were audited in the just-ended financial year and the Central Bank had made a modest profit of Shs 40 billion. He noted that with this profit, the Bank of Uganda is not requesting for any recapitalization because the capital is not impaired.

Government is seeking Shs 45.6 trillion for the new Financial Year.

Justice Kakuru ‘rejects’ bribe offer in Ham-DTB appeal case, dismisses Ham’s application against stay order

Court of Appeal judge, Kenneth Kakuru has rebuked one of the parties in the businessman Hamis Kiggundu-Diamond Trust Bank (DTB) case for sending him emissaries with financial proposals to influence his decision in the matter.

Kakuru made the revelation yesterday while issuing orders to the two parties to file submissions  on the matter and address specific matters in the case following Commercial court ruling that directed Diamond Trust Bank Uganda (DTB-Uganda) and Diamond Trust Bank-Kenya to refund Shs120 billion to Kiggundu.

Kakuru directed the lawyers and their clients to stop sending emissaries to him to influence his judgement.

He said “this matter had been raised by the Principal Judge and he was raising it again. They should allow the courts to perform their duties.” He warned.

The Judge also dismissed application for leave to appeal against the stay order as well as the Appeal against the Stay order filed by Ham Enterprises on grounds that the appeal was already in motion and had been fixed for hearing.

Kakuru’s warning stems from the decision taken last year by Commercial court judge Dr Henry Peter Adonyo that ordered DTB-Uganda to refund all monies deducted from Kiggundu’s accounts in a case involving a syndicated banking agreement between DTB-Uganda and DTB-Kenya.

Kiggundu, through his companies; Ham Enterprises and Kiggs International, had sued DTB-Uganda, accusing the banks of illegally taking away more than Shs120 billion from his bank account in Uganda without consent while he was serving his loans with the same banks.

Justice Adonyo agreed with Kiggundu and ruled that the credit facilities offered by DTB-Kenya to Kiggundu were illegal since DTB Kenya is not licensed to carry out the financial institution business in Uganda.

Adonyo also ordered the banks to return the properties that Kiggundu had mortgaged, refund of the monies the banks had deducted illegally from his accounts. The judge also awarded costs to Kiggundu and imposed a 6 per cent interest on the monies among other several declarations.

But the banks through their lawyers led by Kiryowa Kiwanuka, petitioned the principal judge asking him to issue staying orders such that they do not implement justice Adonyo’s decision. Kiwanuka argued that if the application is not granted, the banks would suffer substantial loss by being required to pay Shs120 billion and approximately Shs9.6 billion in interest on top of releasing the securities deposited with the bank.

Kiwanuka also noted that the decision would to have far-reaching implications on the entire banking sector in Uganda if the implementation is done before their appeal, which has high chances of success is not yet determined.

In his ruling, Zeija noted that the orders need to be stayed because justice Adonyo issued orders in favour of one party in a transaction that he found illegal but made no mention of the sums Kiggundu had borrowed.

Here, Dr Zeija said it important to stay the implementation so that the Court of Appeal can first determine whether the transaction was illegal since it remains an issue of contention in as far as the Contract Act of 2010 is concerned. He said this is because the records show that the banks received independent advice from lawyers before signing the agreements.

Justice Zeija also said the Court of Appeal also needs to first answer the question of agency banking – whether foreign banks that are not trading in Uganda are required to obtain a license from Uganda to execute a contract. The principal judge explained that Bank of Uganda recently released a statement indicating that a license was not required in the transaction under dispute, adding that the Court of Appeal has to first determine whether Bank of Uganda was right or not.

However, yesterday justice Kakuru reasoned that the application by Bank of Uganda to be admitted as Amicus Curiae was disallowed on grounds that BoU isn’t not a neutral party and gave a ruling that they don’t pass the test for Amicus Curiae. They however advised them to join the case as an Interested Party, make an application by 3rd February, other parties respond and they go back to court on February 17, for the hearing of the application.

CHAN quarter-final line-up complete

The line-up for the quarter-finals of TOTAL African Nations Championship (CHAN) in Cameroon is complete with Guinea and Zambia joining on Wednesday night.

The countries to play in the last eight of the tournament were known after the conclusion of the group phase of the competition with the final two matches in Group D

Guinea joined after holding Tanzania to a 2-2 in Douala to top the group with five points, on goal difference from Zambia who had a goalless draw with Namibia in Limbe to finish second in the group.

The two countries will join title holders Morocco, Mali, Congo, Rwanda, Cameroon and DR Congo as teams to play in the quarter-finals.

This comes after the conclusion of the group phase of the competition is designed exclusively for home-based players.

There will be two rest days before the tournament resumes at the various venues.

The quarter-final will start on Saturday when Mali play Congo in Yaounde while DR Congo take on hosts Cameroon at the Japoma Stadium in Douala.

On Sunday, Morocco will take on Zambia in Douala at the Reunification Stadium while Guinea and Rwanda clash at the Limbe Stadium.

NRM’s Ssempijja and Nandawula win Workers seats to KCCA

National Resistance Movement-NRM has won all the two slots of KCCA workers’ representatives. The slots include female and male workers’ representatives.

In an election that took place at Kyambogo Primary School on Wednesday, NRM’s Bismark Ssempijja and Shamim Nandawula emerged winners pulling 282 and 266 votes respectively defeating their NUP closest contenders George Atiisa who scored 26 votes and Shalifah Lilian Mutebbi Birungi who scored 55 votes.

Other contenders include; independent Aziz Ndawula who 12 votes and Denis Otim who scored two votes.

According to Bismark Ssempijja, the voters in trade unions are focused people who are not taken by the wave of political parties. He attributes his success to the good cooperation and hard work he has always shown to fellow workers.

Shamim Nandawula an NRM candidate who won attributes her win to the good will and love of the NRM party by the union workers and pledged to work hard and accomplish what she failed to work on in this term of her office. Nandawula is the Incumbent female councilor for workers.

George Atiisa the NUP candidate who came second on the male counselor said, he did not expect better than what he has got since he knew that his NRM competitor was more powerful than him. He says he will work hard to become the councilor any other time.

According to the Nakawa Division Returning Officer Nancy Kirungi, the voting process delayed due issues like changing of the polling  station from Nakasero primary school to Kyambogo primary school among others.

Meanwhile, some voters including the candidate Aziz Ndawula did fail to vote because they did not find their names in the register, which the returning officer Kirungi said, that that irregularity was due to the missing of some particulars like NIN number among others.

Court to rule on Fred Nyanzi’s electoral petition tomorrow

NRM transition won’t work with Kadaga

She is a product of NRM broad based philosophy of governance. Kadaga was a lawyer in town and more inclined to opposition tendencies. Through her relationship with Ateker Ejalu, she warmed up to NRM. And she got into elective politics winning the Kamuli Woman seat which she has held onto till now.

Shrewdness and manipulation saw quickly rise through the ladder (ku political madala). She exploited President Yoweri Museveni’s strong inclination to promote women empowerment.

Madam Kadaga has since held several government cabinet positions including Minister of Communication and Minister of Parliamentary Affairs.

She settled for Deputy Speaker and it’s from this position that her true personality started to emerge. Her relationship with her boss Edward Sekandi was frosty. She would court a quarrel with him at any opportunity.

Her travel abroad budget was bigger than for her boss. Kadaga would instigate quarrels with Sekandi during commission meetings. However, Sekandi was not the person to be drawn to senseless fights. He let her have what she wanted and sometimes ignored her quarrels.

Then came competition for the seat after Sekandi had done 10 years. Kadaga assembled all women politicians especially from the East to drum up the anti-Sekandi sentiments.

NRM’s current Secretary General Kasule Lumumba orchestrated the plan to have Kadaga replace Sekandi. The two women from Busoga were buddies then. Today, they are bitter rivals.

Kadaga becomes Speaker. The veil was completely removed. Her true colors came to bear.

She used the Speaker position to micro manage parliament to the point that if she sneezes even workers at parliament must hide.

The financial resources at parliament at her disposal and she has used it to buy allegiance from MPs. Fortunately for her the auditor general is a lame duck when it comes to parliament issues.

With the financial muscle at her disposal and MPs under her manipulation, Kadaga begins eyeing Presidency. She was emboldened by the fact that she used her role as Chair of the appointment committee of parliament, to fix mostly her Busoga cronies to public jobs.

She would deliberately refuse a list from the President if it doesn’t have a person of her choice. Slowly Kadaga captured the government bureaucrats.

Then with the budget allocation in parliament, accounting officers started lobbying Kadaga to have their budgets increased.

The bureaucrats who declined to bow to her would be subjected to humiliation whenever they appeared before committees of parliament. This was done under the guise of oversight function. Several accounting officers were cowed.

 

And Kadaga has made a fortune.

She is one of the richest in the land but makes public utterances that portray Westerners as the thieves and the richest. This was indeed to keep the westerners in fear and President Museveni not to touch her.

Those close to her have confessed that the woman wants only one thing now: To be the first woman President of Uganda. All her eyes are on that.

Her setback is the fear of Museveni.

But she has been working around that fear by marketing herself as an independent mind who doesn’t condone wrongs in government.

Her idea was to have masses on her side and eventually overwhelmingly embarrass Museveni. It’s the reason she fights whoever she perceives to be having Museveni’s ear.

Time is running out on Kadaga because Museveni is still around. She sees her dream hitting a dead end.

The option now is stick as Speaker and control parliament so that if she gets more MPs to her side, she can attempt an impeachment process.

When NRM reacts to her badly, then she instigates constitutional amendments that can scatter all Museveni’s plans.

She also wants to instigate a breakaway when Museveni least expects it. She can only do this when she controls parliament budget. She doesn’t want any idea of becoming VP kubanga it doesn’t take her to her dream.

The war between her and Mbabazi was precisely about this. Mbabazi had held the party machinery so well.

Lumumba has had difficulty doing so because Kadaga has a bigger budget to disrupt Secretariat work.

As the race for Speaker heats up, Kadaga’s card is to try to put Museveni on a wall.

Her team is going to sound tribal sentiments, women card and they are going to portray NRM as a party facing a split.

This they hope will make Museveni cow down and again ask Oulanyah to step down.

She is lining up her allies in the women movement and some MPs to begin making statements. But they know that if Museveni gets serious, they have no way out.

All plans to blackmail Museveni into supporting her are being finalized. However, it’s President Museveni and NRM who will pay a heavy price of Kadaga’s as Speaker. In case of any transition plans, Kadaga is not the person to steer the legislature.

It will turn out to be a hammering ground for NRM aspirations. She wants Presidency not Speakership any more but the latter is her vehicle to her aspirations.

Nothing wrong to aspire but undermining the collective values and processes of NRM is the matter. An enemy within is dangerous than the enemy outside.
