Akena death: Courts differ on Kanyamunyus’ appearance

The High Court has disagreed with a lower court on the day on which the Kanyamunyu brothers should appear in court.

Nakawa Magistrates court had in the morning ordered Mathew Kanyamunyu, his girlfriend Cynthia Munwangari and brother Joseph Kanyamunyu to appear in court on January 17.

This followed a request by the State Attorney Rachael Nabwire, who asked Nakawa grade one magistrate Noah Sajjabi for ‘more time’, informing court that they were still carrying out investigations.

The trio is accused of murdering child activist, Kenneth Akena.

However, a few hours after the decision, the High Court in Kampala ordered Luzira prisons authorities to produce the three in court a week earlier, on January 10, for their bail application to be heard.

Initially, the Nakawa Magistrates Court was to commit them to the High Court once investigations were done.

Prosecution alleges that on November 12, while at Game Stores, Kanyamunyu, in company of his girlfriend, allegedly shot Akena whom he accused of scratching his car, and drove him to Norvik hospital, where he died from.

His brother Joseph Kanyamunyu is held on condition that the telecom printouts indicated that he was contacted immediately after the incident, which puts him in position to be having some knowledge on the incident.
