Court frees MP Zaake after spending 10 days in jail

Gulu High Court judge, Justice Stephen Mubiru , has released Mityana Municipality Member of Parliament, Francis Zaake on Shs5 million non-cash bail after spending 10 days in Gulu central prison.

Zaake was on February 12, picked at Clock Tower in Kampala and detained at central Police station (CPS) before being taken to Arua court over chaotic scenes that proceeded the conclusion of municipality by- election campaigns.

He was later produced before Gulu grade on Magistrate, Justice Lubowa Daniel, and charged with escaping from lawful custody however, through his layers led by Counsel Tony Kitara, he applied for bail. His application was granted and released on Shs50 million non cash bail as his sureties were bound to pay shs50 million non-cash.

Moments after being fled, Zaake was re-arrested and driven to Gulu magistrate, Isaac Kintu, who leveled him with charges of treason and malicious damage of president’s vehicle. He was subsequently remanded for three weeks in Gulu central prison.

However, through his layers led by Henry Komakech Kilama, Zaake petitioned High Court seeking for his release from prison.

Appearing before Justice Mubiru , this morning, counsel Kilama told Court that it is a constitutional right for his client to get bail as stipulated in Article 23 (6) of the 1995 Constitution of the Republic of Uganda.

He further told court that Mr Zaake is compliant to the law and has a fixed home in Mityana where he is found and will report to the honorary court whenever is required to.

He presented his wife, Bridget Namirembe, his brother Daniel Mugambwa and Butambala County Member of Parliament for Muhamad Muwanga Kivumbi who were bound to pay Non- cash bond of Shs 10 million and ordered to report to court on 14 March, 2019

The MP is among the group of the 34 suspects who were detained in Gulu police cells and was reportedly dumped at Rubaga hospital by unknown security officers following the deterioration of his health condition. President Museveni reportedly said he had escaped.

They were arrested on Augusts 13, hours after holding their conclusive rallies head of the Arua by-election that was won by Kassiano Wadri. He was nabbed along with Robert Kyagulanyi, Ntungamo Municipality MP Gerald Karuhanga, Jinja East MP Paul Mwiru, Kassiano Wadri, former MP Michael Mabikke, and 28 others grappling with charges of treason and malicious damage of president’s vehicle.
