PRESS STATEMENT: Arrest and illegal detention of Red Pepper Journalists

OMPA CHAIRMAN: Giles Muhame

The Uganda Online Media Publishers Association (OMPA), notes with concern the recent raid by the Uganda Police of the premises of The Pepper Publications Limited, the arrest of 8 directors and senior editors and the subsequent shutdown and or prevention of publication of their following titles:

  • The Red Pepper  Newspaper
  • Kamunye News Paper,
  • Entatsi Weekly News Paper,
  • Red Pepper –Online.

Their radio station- Juice FM -103.4 has also been taken off air.

While OMPA respects the mandate of the Uganda Police to keep law and order, we are equally concerned and deeply troubled that the 8 directors are now being detained beyond the constitutional 48 hours.

We are also concerned by the confiscation of all their tools of trade, the destruction of their servers as well as the shut-down and disruption of the business- especially at a time when the economy is difficult and unemployment levels are on the rise.

We are also concerned that the suspects are being held at the notorious Nalufenya detention centre- a facility that is 70 kilometers away from their families and loved ones and has most recently been flagged as a torture center for suspects.

We are very concerned about the unprecedented treason charges preferred against them; treason is a capital offence punishable by death. We believe these frivolous charges, at a time when state prosecutors attached to the Directorate of Public Prosecutions (DPP) are on strike and the consequent indefinite suspension of all criminal sessions by the Judiciary are designed to detain the journalists for longer than necessary.

The arrest and detention of The Red Pepper journalists, comes days after 2 other Journalists and members of OMPA were arrested and detained beyond 48 hours- for over 168 hours, even when the High Court had ordered for their unconditional release.

We wish to protest strongly, this continued inhuman and degrading treatment such as arbitrary deprivation of property and unlawful arrests that sometimes include instances of charges under laws that courts have declared to be inconsistent with the Constitution. There are increasing reports of journalists being denied access to news scenes and their equipment being confiscated, damaged or destroyed by state agencies that should ordinarily be protecting us.

Ultimatum

Given that our colleagues have already been detained beyond the constitutional 48 hours, OMPA would like to demand that:

  • Our colleagues be brought to competent courts of law and charged accordingly;
  • They be granted immediate access to their families and loved ones;
  • The siege on The Red Pepper premises be lifted and the business be allowed to resume;
  • That police ceases the persistent mistreatment of journalists all over the country and that those who violate rights of journalists be brought to book;
  • Additionally, those implicated in previous cases of torturing journalists be appropriately punished.

Should our colleagues not be brought to court today, OMPA will declare a ban on coverage of all police activities and events for a period of 2 months.

We also wish to call upon all other media houses to join this ban as we fight for and defend our right to freedom of expression and the safety of all journalists in Uganda; an attack on one is an attack on all of us.

In the same strong terms, we wish to call upon all OMPA members and all journalists in the country to observe the key journalism principles i.e. truth and accuracy, independence, fairness and impartiality, humanity and accountability.

We should all remember that journalism’s first obligation is to the truth, its first loyalty is to citizens and its essence is a discipline of verification.

Public Service choking with fake academic papers

PSC Chair Justice Ralph Ochan

The Public Service Commission has expressed concern over the increased fake academic documents applicants are using to apply for government jobs.

The concerns were raised by Ralph Ochan, the Chairperson of Public Service Commission, while handing over the 2016/2017 annual report to the Speaker of Parliament yesterday.

“The Commission continued to grapple with challenges associated with applicants who presented forged documents in order to secure jobs in the Public Service,” Mr. Ochan, a former High Court Judge, said.

As a result, Mr Ochan the Commission was forced to work closely with the awarding institutions to verify the documents and then with the police to apprehend and investigate the culprits.

The Commission Chairperson also noted that modalities are being worked upon with the Uganda National Examinations Board (UNEB) to reduce on the verification costs.

“Verification of the academic documents was done at a cost which aggravated the financial problems of the Commission further. We are in the process of negotiating with UNEB in order to come to a mutual agreement on modalities for cutting down the verification costs,” Ochan said, adding that the Commission has now asked for increased funding of this activity with Shs50 million being planned to carry out the exercise.

The Commission painted a grim picture on the high unemployment rate in Uganda citing an example of the huge numbers of candidates applying for jobs in the Public Service without a corresponding increase in job opportunities.

Ochan pointed out the Graduated Recruitment Exercise for 2016/2017, where 10,057 applicants sent in their applications against 154 vacancies; representing a vacancy applicant ratio of 1:65.

However, the Commission is also battling with practices like bribery, awarding of marks, coaching  candidates, conflict of interest, coercion and political interference that have become the order of the day, as reported from District Service Commissions, Mr Ochan added.

Journalists’ lobby condemns Red Pepper arrests

UNDER SIEGE: Police at the Red Pepper offices in Namanve

The Human Rights Network for Journalists Uganda (HRNJ-U) has today condemned the continuous detention of Red Pepper journalists who were arrested on Tuesday for the publication of a story alleging that president Museveni wants to cause overthrow the government of Rwanda led by Paul Kagame.

The five Directors and three editors were arrested on Tuesday by police counter terrorism unit under a search warrant obtained from Buganda Road Magistrate’s Court, by Deputy AIGP Henry Peter Walya. During the search at the Red Pepper offices in Namanve, electronic devices include computers and laptops were taken by investigators.

According to Red Pepper lawyer Dickens Byamukama, those arrested and detained at the notorious Nalufenya Police Station include Directors Richard Tusiime, James Mujuni, Johnson Musinguzi and Arinaitwe Rugyendo, while the Editors are Francis Tumusiime, Ben Byarabaha and Richard Kintu.

“We highly condemn the continued detention of the Red Pepper Editors and Directors at Nalufenya, a place known for hardcore criminal suspects without any justifiable reason. We believe that this is economic sabotage aimed at occasioning the media house financial loss since all its production has been stopped,” HRNJ-U Coordinator Robert Sempala said at the paper’s offices.

He added that the attack and closure of media houses in such a manner is uncalled for since the implicated personnel can be summoned to the police for interrogation and then taken to court.

“Such acts violate the constitutionally guaranteed right of freedom of expression and the media in Uganda which we must resist against,” Sempala added.

Following the 1-1 draw with Congo Brazzaville in the last World Cup qualifier match, the Cranes have a total of 503 points which puts the national team at 15th position in Africa.

However, Uganda remains the best in East Africa after neighbours Kenya dropped nine slots to 111, Tanzania to 142, Burundi to 138 and Rwanda down to 120.

Senegal have risen to 23rd, their highest-ever position on the global ladder after securing a first World Cup place since 2002. They are now the top-ranked African nation, having leapfrogged fellow Russia 2018 qualifiers Tunisia (27th, up 1) and Egypt (31st, down 1).

The top five countries in the world maintain their spots: Germany, Brazil, Portugal, Argentina and Belgium, respectively.

FIFA rankings are based on the average number of points that a team accumulates over a four-year period. The ranking points in each match are determined by its result, its value and the relative strength of the opponent and their confederation. The system also has yearly basis depreciation for the value of the matches.

The next FIFA/Coca-Cola World Ranking will be released on December 21, 2017.
